Cox High-Speed Internet Class Action Lawsuit

Cox Communications promises high-speed internet in Louisiana, but it can’t deliver, according to a federal class action lawsuit filed in Louisiana.

 

The Cox high-speed internet class action lawsuit claims Cox advertises a three-tiered high-speed internet service that is advertised to provide speeds up to 4 Mbps for the “Essential” service, speeds up to 18 Mbps for the “Preferred” service, and speeds up to 30 Mbps for the “PowerBoost” service, but in many areas across the state it “simply cannot provide those services to its subscribers at speeds that are remotely close to the speeds it promises.”

 

Cox is the only available broadband internet service in many areas throughout Louisiana. Each designated area has a “node” which provides the high-speed internet service to a specific number of customers. Due to increased household internet usage, however, the nodes in certain geographical areas become so over-saturated that Cox is forced to split the nodes to decrease the number of customers that are serviced per node, rendering these nodes incapable of producing the internet speed Cox promised to its customers, says the lawsuit.

 

The Cox Communications class action lawsuit takes aim at the company’s many advertisements that promote its high-speed internet service as being the “fastest internet period” and promising customers a “high-speed internet performance pledge.”

 

To back up its claims that Cox’s high-speed internet ads are false and misleading, the class action points out extensive research done by the FCC in 2009 that showed the actual internet speed provided by companies such as Cox were roughly 50% of the advertised speeds.

 

The Cox class action lawsuit is brought on behalf of a proposed class of all subscriber to Cox internet services in Louisiana who paid for internet services within the past five years and whose service does not meet the speeds advertised by Cox and/or whose internet service was or is provided by an over-saturated node.

 

It is seeking class certification, damages and restitution, and other relief.

    We have the same problem here in California. This company is a scam, they promise a service they cannot provide but take your money anyway. I have complained to them for over 7 years about our service and how we are not getting what we are paying for, they do the typical hand off from one department to the other and nothing ever gets resolved, in the meantime, we are getting a huge cable and internet bill each month, No other alternatives available in our area.

      Yes, I got your same experience! Cox lied to me repeatly after I did use speedtest app to find out I got average 50 MBPS, sometimes 25, sometimes awful 1.5 mbps like up and down rollcoasts daily,
      Cox sent me few different techies at my home. One guy said blamed old cables somewhere in your condo building where have 8 units. Then, Cox send me other techie again after I complainted and told Cox, I dont buy first guy’s story then 2nd guy came and had deep test, he said Blamed Cox’s problem, not your problem cables in condo building. Later, my home still get same problem internet like up and down rollcoasts daily, I called Cox tech support then he said we have to send techie over to your home again. Now, I suspect that Cox know they get big problems then managers told techies and customer service to follow scripts: they treated like customers talk to the parrots. Jerk customers around, send customers to different Depts, worn customers down and burned out. I believe we should sue Cox by class suit action for failed to promise us for high speed interent like 150 or 300 MBPS.

    How can I be a part of this? The only Cox internet package available to me was the 100mbps package, and the best I have ever received was 50mbps, and the usual speed is about 20mbps. In order to get the actual speeds, they want to Gouge an additional 9.99/month for Line Maintenance. The cable lines at my complex are a huge fire hazard, too, as they are completely exposed and tangled up. 9.99/month to fix that.

    No only do they provide fraudlent speed, when you complain you are then cyber stalked and cyber bullied by cox abuse and cox security. They offer free security with your service, not true it is spware, malware, and a Trojan horse, when you complain to tech support, they claim you have a Trojan virus. This complaint is after installing the so called free security.
