GNC TriFlex False Advertising Class Action Lawsuit

GNC TriFlexGNC Corporation has been hit with a class action lawsuit accusing the nutrition company of falsely advertising that its dietary supplement TriFlex will promote mobility and flexibility, improve joint comfort and cushion joints.

California plaintiff Michael Lerma says GNC TriFlex, TriFlex Fast-Acting and TriFlex Sport products are promoted with a number of false advertising claims, including that they contain a “maximum,” “clinical strength” formula that supports “joint comfort,” promotes “joint mobility and flexibility” and “protects joints from wear and tear.”

In truth, he says, the TriFlex Products do none of this.

This is especially true if you pay for each text message or if receiving these spam messages puts you over the limit for the month. Unfortunately, despite privacy laws, many retail giants – and some not so giant companies – are using your cell phone numbers to send out mass targeting advertising. Even if you’ve never given out your cell phone number, you may find yourself on the receiving end of these marketing (read: spam) messages. There is something you can do, however, to stop these messages from taking over your life – and your cell phone bill.

Know Your Rights

First and foremost, you should be aware of the rights you have as a cell phone owner. After all, you do pay the bill and despite the fact that there are unscrupulous marketing agencies out there that violate your privacy without a second thought, there is help in the form of the Telephone Consumer Protection Act, or TCPA.

BofA to Pay $500 Million to Countrywide Mortgage Investors

Bank of AmericaBank of America’s Countrywide unit has agreed to pay a record $500 million class action lawsuit settlement with investors who claimed they were misled into buying billions of dollars in mortgage-backed securities that were downgraded to junk after the 2007 subprime collapse.

The Countrywide mortgage settlement is the largest ever reached in a federal class action lawsuit over mortgage-backed securities. The consolidated case was filed in 2010 by MBS purchasers who allege Countrywide subsidiaries made false statements about the quality of the mortgages. Countrywide specialized in providing loans to borrowers with poor credit histories or who could not document their ability to repay a loan.

Kashi Mislabeled Products Class Action Lawsuit

KashiA California consumer filed a class action lawsuit Monday against Kellogg Company Inc. and Kashi Co. claiming Kashi products are mislabeled in order to hide the amount of sugar they contain.

Plaintiff Nadine Saubers says the companies are violating a number of laws by labeling the Kashi products as containing “evaporated cane juice” instead of what the ingredient really is – sugar – and by failing to disclose that the ingredient is still considered to be processed sugar.

New Ben & Jerry's Ice Cream Settlement Tentatively Rejected

Ben & Jerry'sA California federal judge on Monday refused to sign off on a proposed $1.3 million class action lawsuit settlement over claims that Ben & Jerry’s ice cream is falsely marketed as “all natural,” saying he wants both sides to explain how the deal would benefit Class Members over a previous deal that was rejected in September.

Xbox LIVE Target of New Potential Class Action Lawsuit

Xbox 360Microsoft has been the target of numerous class action lawsuits recently over its Xbox LIVE subscription service. Irate customers have accused the company of everything from breach of contract to double-billing to even forbidding them to file class action lawsuits. Now a new investigation has been launched looking for Xbox LIVE subscribers who cancelled their subscription before October 2011.

The details of the new Xbox LIVE class action lawsuit investigation are vague, but could affect thousands – if not hundreds of thousands – of former customers. There are currently over 25 million Xbox LIVE subscribers who use the service to instantly watch HD movies, TV shows and sports on their TV through their consoles.

Bank Foreclosure Abuse Settlement Update: Delayed Check Cashing to Be Resolved Soon

bank foreclosure absue settlementPayments for the bank foreclosure abuse settlement began April 12, but some Class Members are reporting their checks can’t be cashed due to “insufficient funds.”

Rust Consulting, the Settlement Administrator, confirmed that $3.6 billion is available to be cashed or deposited, but that some early payment recipients encountered problems with their banks.

Honda Civic Rear Suspension Defect Settlement Preliminarily Approved

HondaA federal judge has preliminarily approved a class action lawsuit settlement between American Honda Motor Co. and consumers who allege the automaker knowingly sold Civic and Civic Hybrid models with a rear suspension defect. The deal will require Honda to replace the allegedly defective Civic parts and the prematurely worn tires it caused, and reimburse consumers who have already paid out of pocket.
