Details: Only 2004 and 2005 Model Year DLP TVs are covered by this settlement. Any of the following models: 44HNHM84, 46HM84, 46HM94, 46HM94P, 52HM84, 52HMX84, 52HM94, 52HMX94, 62HM84, 62HM94, 62HMX84, 62HMX94, 62HM194, 46HM85, 46HM95, 46HMX85, 52HM85, 52HM95, 52HMX85, 52HMX95, 56HM195, 56MX195, 62HM85, 62HM95, 62HMX85, 62HMX95, 62HM195, 62MX195, 62HM15, 62HM15A, 62HM15B, 72HM195, and 72MX195.

 

This settlement extends the warranty on the TV's bulbs from 6 months to 12 months. In addition, certain serial numbers also allow you to claim a refund for DLP bulbs purchased within the warranty period of the TV.

 

Certain serial numbers are not eligible for a refund of charges incurred from purchasing replacement bulbs. The serial numbers below are not eligible for a refund as they were included in a previous"remediation" program.

The 2005 model year serial numbers below are eligible for a refund for charges incurred from purchasing replacement DLP bulbs as long as the bulb (or bulbs) were purchased within 24 months of the sale date of the TV.

Under the settlement, owners of all 2004 model Toshiba DLP televisions, and owners of those 2005 model Toshiba DLP televisions that do not fall within the range of serial numbers covered by the Remediation Program, who experienced a single bulb failure outside of the 12-month warranty period, but within 18 months from the date of purchase of the television, will be eligible to receive a cash refund for the purchase of the replacement bulb.
Owners of all 2004 and 2005 model Toshiba DLP televisions who experienced two or more bulb failures outside the 12-month warranty period, but within 24 months from the date of purchase of the television, will also be eligible to receive cash refunds for their purchases of replacement bulbs.

 


Finally, owners of those 2005 model Toshiba DLP televisions that fall within the range of serial numbers covered by the Remediation Program, and who purchased one or more replacement bulbs outside of the 12-month warranty period, but within 24 months from the date of purchase of the television, will also be eligible to receive cash refunds for their purchases of a replacement bulb or bulbs.

 

If you fall into one of the above categories and wish to seek a refund for one or more replacement bulbs that you purchased, you will need to submit a claim to Toshiba to claim your refund, and to provide proof of purchase of your television and for each replacement bulb for which you seek a refund

Class Action Lawsuit Settlement Amount(s): $Unknown (not listed in the settlement agreement) plus $265,000 in Attorney Fees plus $18,000 in Lead Plaintiff Incentive Awards, plus $3500 in additional litigation expenses minus administrative costs (advertising the notice, settlement administrator expenses, etc.). Since Attorney Fees are usually about 15 - 30% of the total settlement amount we can make a guess that the Settlement Amount is between $1,500,000 to $3,000,000. If you know the real amount, send us a note!

 

TCA Staff Tidbit: This is only interesting settlement if you own a Toshiba DLP TV and have had bulb problems. So, hopefully if you had a bulb that died and you purchased a replacement you have your receipt. With the age of GMail upon us, you save ALL of your electronic receipts forever, right? :) I remember when I was looking at buying one of these sets back in 2004 the main reason I didn't is because of complaints about the bulbs wearing out prematurely. I'm happy I stayed away and waited for Plasma big screens to come down in price.

 

Our supposition is that Toshiba is attempting to brush this settlement under the rug... It only ran a few times in the national media and the budget for administrative expenses (including advertising to reach the affected class) is almost none existent. A few thousand bucks covers one nationwide legal notice. That's about it. I'm willing to bet that Garden City Group's (the Settlement Administrator managing dispersion of the refunds) margin on this is quite tiny. Competition is tough for Settlement Administrators right now so I hope they're covering their expenses on this one.

 

An interesting item from this case is the Lead Plaintiff incentive payments. The MINIMUM payment is $3,500, and the max a Lead Plaintiff is receiving is $5,000. That's pretty good. Of course, all of their travel expenses have been covered for depositions, but for such a small settlement overall ($1.5 - $3 Million estimated) I think they did pretty well. So, if you can, MAKE YOUR CLAIM! Also, remember, the only way to become a Lead Plaintiff is to be one of the first people filing the lawsuit! Submit your complaint now. If an attorney in our advertising network picks up the case you're on your way to being a Lead Plaintiff in a case!

I have a Toshiba TV that i bought 2.5 years ago for $2000.00, and the DLP LAMP needs to be replaced, so i called TOSHIBA to order a new one then they redirected me to another vender "CAPRI", the lamp + case cost 250.00+TAX = $282.00 and when i inserted the new bulb the TV won't start. The light Indicator turn to orange (after i turn it on) then few seconds it is back to RED. as per my troubleshooting i tool the bulb out, power'd the TV, then turn it on and i got the same indicator turns from RED to ORANGE then after few seconds back to ORANGE. My understanding after this is that the problem is still with the bulb" deffected from the manufacturer" but since i am not the expert i though that TOSHIBA's support will help, BUT unfortunately they only want you to spend more and more money. 

I sent an Email to Toshiba support and there answer is to take the TV to the service center so i can get charged again another 2 to 300.00 for some bull Shit, TOSHIBA's SUPPORT SUCKS AND I AM REALLY DESAPOINTED WITH THEIR ANSWER, I WAS EXPECTING AN ANSWER LIKE IT MIGHT BE THE LIGHT BULB IS BROKEN FROM THE MANUFACTURER BUT NO!!! THEY ONLY WON'T US TO SPEND MORE MONEY  (it's like the 2000.00 already spent on the TV for only 2.5 years is not enough). And is it really normal that i pay 2000.00 for a TV that will brake within 2.5 years ?

To be honest i am really disapointed by their service, their product and i hate to feel that i got riped OFF. from now on NO MORE TOSHIBA PRODUCTin my house.

If any one know about a law suite against Toshiba for this product, or has an idea to suggest for my situation, please feel free.

Just replaced the lamp for second time. This time around I cannot get the TV picture to come on. It appears to be stuck in a continuous cycle of the red and green LED's cycling and flasshing with no picture. I am so disappointed in this TV. John MD 410-287-8484.

Bought a 52MHX84 in 2004.  1st bulb lasted 1400 hours.  2nd lasted 1400 hours.  3rd lasted 10 hours.  4th  lasted 1 hour. -- not buying 5th...  What a hunk of shit!  Anyone want a free 52" paperwieght?

I bought a 56hm66 about 18 months ago, the bulb blew about a month ago.I bought a new bulb and it lasted about 30 minutes,bought a third bulb and it lasted 15 minutes and i never got a picture at all. Basically im F'ed<EDITED BY MODERATOR> out of 2000 dollars,I would like to walk into their plant and beat the S <EDITED BY MODERATOR>out of everyone of them a**holes<EDITED BY MODERATOR>.Tell everyone not to buy from these scumbags from toshiba.

I got somthning in the mail saying there was a suit against toshiba bubs but lost the paper , i'm going on bulb #3 ,will they refund the full cost?

Bot TV in 12/2006.  Have replaced the bulb 3 times.  Toshiba paid for only 1.  This last time the TV still wont go on with a new bulb.  Place I bot the bulb from said it sounds like the balast is bad.  Toshiba doesnt sell the part so i have to hire a TVrepair shop to come out and fix it which god only knows what thats going to cost.  I am now in the mkt for a new TV.  Never Toshiba again!!

I have a model 56HM66 Toshiba DLP which I purchased in December of 2006, which aparantly is not part of this lawsuit when it should be. Just three and a half months after the warranty ran out the bulb blew. I called Toshiba and asked about the 5000 to 8000 hour lamp life. They denied that fact and said at that time the lamp was only warrantied for 90 days, but would be more than happy to transfer me to patrs so I could order a replacement lamp. The price I was quoted was $239.00 plus 19.95 shipping. I said that's a crock!! I searched the internet and found a company that sold the lamp for $229, free shipping and a 12 month warranty, which they backed completely. I ordered the lamp in April of 2008 and in September 2008 the replacement lamp blew. DLP lampsource replaced the lamp, no charge, no questions asked. It is amazing that an outside company is willing to warranty a part longer than the manufacturer of the product.

Later I had questioned Toshiba about the lamp problem. I told them my story about them stating a 90 day warranty of the lamp and so on. I asked if they could tell me if there was something wrong with the TV causing the lamps to blow prematurly. The response I got was, the lamps are warrantied for 6 months, provide a receipt of purchase and if within that time period we will replace it.

I have been a loyal Toshiba customer until purchasing this DLP TV. I will never purchase another Toshiba product ever again. Also I am unhappy with Consumer Reports with their report on DLP TV's. They said that DLP TV's were the least expensive to maintain. This is also why I am angry with Consumer Reports. I was recently researching a Samsung DLP TV which I almost purchased instead of the Toshiba. I found that they had the same bulb problem and they also had a color wheel  and light engine problem, which are very expensive repairs compared to replacing just a broken lamp.

When people get burned like this, we should just stop buying their products, and we should post our complaints to help each other and make a difference. I know there are other people that got burned far worse than us and I feel bad for them. I hope this informatin is helpful to someone.

In the future I will do a lot more research before purchasing another TV.

THEY COMPANY HAS TO BEEN HE WORST IN CUSTOMER SERVICE-NO ONE WILL ADMIT THERE IS

PROBLEMS WITH THESE BULBS/TV;I HAVE WAITING FOR A BLUB FOR 3 WEEKS BY MY EXTENDED

WARRANTY-BUT THEY ARE BACK ORDERED-WHAT DOES THAT TELL YOU;I WILL NEVER-NEVER

I PURCHASED A TOSHIBA 46HM84 AND I HAVE REPLACED THE TWICE THIS YEAR. I AM VERY DISSATIFIED WITH THIS TELEVISION. I HAVE NEVER SEEN A TELEVISION DO THIS. I FEEL THAT TOSHIBA SHOULD REFUND EVERYONE THAT HAS THIS TELEVISION OR REPLACE IT WITH ONE OF THEIR TELEVISION THAT DO NOT HAVE THIS PROBLEM. I PAID 2000.00 FOR THIS T.V. AND AFTER ALREADY REPLACING 2 BULBS I FIGURED OUT THAT A THE COST OF 389.00 OF A LAMP AFTER PURCHASING ABOUT 5 I COULD HAVE BOUGHT A NEW TELEVISION. THIS IS NOT GOOD BUSINESS AND THOUGHT THAT BUYING A WELL NAME BRAND I WOULD GET BETTER QUALITY BUT I GUESS I WAS WRONG.

I just replaced another bulb on 11/1/2008 and yesterday the bulb went out again.  This is the fourth bulb that has been replaced in my toshiba television.  This is absolutly not right.   I want to know what I can do to get a refund or replacement of my television?  Please let me know.  I can be reached either by email or phone at 269-965-8659.

  1. I bought a 62dlp from HHgreg in georgia; And I bought the 5 year extended warranty. Unfortunately, their vendo at Global has no idea what is going on with these lamps that go out ever 4 to 6 months. They now refuse to send me a lamp until a new technician comes out and inspects the tv. The technican called me and said he would be out to change the bulb in a few days but he is aware these toshibia dlp tvs have this problem. Now Corporate HHGreg needs to know and comply with the extended warranty agrement
  2. I just purchased my second bulb in less then 1 year on my 46HM94P.....it sucks. I agree with you all...need a refund or a new TV

I sent in copies of 2 original receipts for 2 bulbs that lasted less than 3 months for my Toshiba DLP to the Garden City Group prior to the June deadline and they kept my receipts and sent me back two new forms to fill out and send back to them by the 21st of August. They said that my proof of purchase for the two bulbs was insufficient. I originally sent to them a signed paid receipt from a internet store for one of the bulbs and a Paypal e-mail receipt for the other bulb that I bought on E-bay. I called the number for the Garden City Group and left a message on their answering machine to call me and they have yet to return my call. I wanted to ask them why the paid signed dealer receipt for payment of one bulb was not acceptable and why the Paypal receipt for payment of the 2nd bulb was not accepted. It looks like Toshiba and the Garden City Group are in bed together.
  4. I will say that the bulbs in these toshiba suck no doubt about it . I just ordered my third one today. The only saving grace is that I bought the 4 year warranty from best-buy for 399.00 . So I ain't been out a penny. If you buy electronics buy from best-buy and get the warranty, becaus I could be out around 700.00 dollars right now. I will never buy a dlp again just lcd.
  5. So I work for the Garden City Group and I take these calls all day. Note: Garden City Group is in NOWAY affiliated with Toshiba and can NOT express their personal opinion on any cases, Trust me, there are plenty of times where the people I work with would like to, BUT WE ABSOLUTELY CAN NOT!! We are given stipulations by the court and terms of the settlement that we have to relay to those who have been affected....... MY JOB SUCKS. We can't show biased to the plaintiffs or the defendants or we'll be in serious trouble. So when calling the Garden City Group please be nice to us, we don't want to be yelled at because some company allegedly (I have to say allegedly) screwed a ton of people over......It is not our fault, we aren't the attorneys that negotiated the terms of the settlement, we are not the judge overseeing your case..
  6. Three bulbs in two years. I am not happy! The settlement administrator sent a letter saying that my bulb purchases were out of the settlement period. They were not. I am appealing and I hope that someone will listen. 3rd bulb just went out yesterday...It's sad when once you've already purchased your television...you cant afford the bulb replacement.
