Michaels class action lawsuit

Michaels Stores Inc. has agreed to settle a class action lawsuit over allegations that it collected the ZIP codes of customers during credit and debit card transactions in violation of Massachusetts law. If you shopped at a Michaels retail store in Massachusetts from May 23, 2007 to Feb. 12, 2014 and you were asked to provide your ZIP code when you made a credit or debit card purchase, you could be eligible for benefits from the Michaels ZIP code class action settlement.

Who’s Eligible

Class Members of the Michaels ZIP code class action settlement include anyone who, between May 23, 2007 and Feb. 12, 2014, used a credit and/or debit card in a purchase transaction at a Michaels retail store in Massachusetts and were asked to provide personal identification information such as a ZIP code during the transaction. There are two subclasses for the class action settlement.

Subclass One: Includes all known Massachusetts customers who conducted a consumer credit card and/or debit card purchase transaction with Michaels and from whom Michaels requested and recorded the customer’s personal identification information, including but not limited to, a ZIP code, and obtained the customer’s mailing address solely by the ZIP code append.

Subclass Two: Includes all known Massachusetts customers who conducted a consumer credit card and/or debit card purchase transaction with Michaels and from whom Michaels requested and recorded the customer’s personal identification information, including but not limited to, a ZIP code, and obtained the customer’s mailing address from a source other than the ZIP code append.

Potential Award

$10 or $25 voucher. Members of Subclass One who do not opt out of the class action settlement will receive a $25 voucher, while members of Subclass Two who do not opt out will receive a $10 voucher. The vouchers can be used at any Michaels retail store in Massachusetts within 90 days from the date of issue.

Proof of Purchase

None required. Under the terms of the Michaels class action settlement, cash vouchers will be mailed to Class Members within 20 days after the class action settlement gets final approval.

Case Summary

The Michaels ZIP code class action lawsuit alleged that Michaels violated Massachusetts law by collecting customers’ personal identification information, including ZIP codes, when they used a credit or debit card during a transaction. Michaels allegedly used this personal identification information to identify its customers’ mailing addresses for the purpose of sending marketing materials.

Michaels denies that its actions violated Massachusetts law, but has agreed to settle the class action lawsuit to avoid the cost and risk of a trial. A Massachusetts federal judge preliminarily approved the class action settlement on Feb. 12, 2014.

    When I clicked the “file a claim” nothing showed up……how convenient. I suppose the deadline will pass before they add that.

        the Massachusetts case, just the Beverly one.”

      I don’t think you have to file a claim, since you used a credit card they have your info and will mail you a voucher.
