Details:  The New Balance settlement will resolve a class action lawsuit, entitled Carey v. New Balance Athletic Shoe Company, Inc., that alleges New Balance falsely advertised the health benefits of wearing its True Balance toning shoes to consumers. According to the class action lawsuit, claims that the shoes could burn up to 10-percent more calories with every step, create 29-percent more muscle activation compared to regular walking shoes, and that these figures were backed by scientific evidence simply were not true. The lawsuit further alleged that the shoes may actually lead to injury, "a fact which New Balance deceptively omits from its advertising."
 
New Balance denies any wrongdoing, but has agreed to establish a $2.3 million class action lawsuit settlement fund to reimburse consumers in order resolve the litigation.

Class Members of the New Balance toning shoe class action settlement include all persons or entities that bought the following toning shoes from New Balance U.S. retailers, New Balance Stores, shopnewbalance.com, joesnewbalanceoutlet.com, New Balance Outlets, or other third-party retailers from January 1, 2010 through August 29, 2012:

Class Members who submit a valid claim form by the deadline of February 25, 2013 will receive a pro-rated share of the $2.3 million New Balance class action settlement. If the total value of all approved claims submitted by Class Members is less than the amount of money available to pay claims, each eligible Class Member's award will be increased on a pro-rata basis to a maximum of $100. Class Members may submit more than one claim if they purchased more than one pair of New Balance toning shoes.

Lawyer get $950,000 of the 2.3 mil,etc
so there is over 3 million ppl in the class action,each claim would get $1-$8.
not worth the time to cry about when will I receive a check.

Correction..... .the date was 120 days from the final hearing date or claim deadline, whichever was later. Since the claim deadline was Feb 25, 2013, they have until June 25 2013 to have all payments disbursed.

According to the terms of the settlement agreement, they have 120 days from the final hearing date in order to get checks out. That day would be by June 25th 2013, so we probably will not see checks til around that time.

called and spoke w/ Laurie and she advised me although checks were anticpated for the end of April, she has no idea when checks will be going out. When I asked for the status of my claim: she told me that no determination has been made.... to me, this matter is just out of control.. the fact that no determination has even been made seems as if check probably wouldnt go out for another few months..

Wow, this is interesting...m any of u in the feed are saying they have sent you letters asking for proof of purchase. I haven't gotten anything like that, and it wasn't mentioned when I called in this morning for an update. Still no word on when payment will be received, but I'm thinking perhaps we should file a class action against the attorneys, particularly in this suit. I notice that this firm in particular is making a fortune taking on class actions and winning them. Huge payments consisting of millions while the consumer gets pennies on the dollar or in some cases nothing at all. Another thing that could be a possibility when dealing with these greedy liars (lawyers) would be to write a formal complaint to the bar association in their area. Lawyers take a ethics oath and are suppose to follow it which rarely happens as you can see. I'm not sure if its even worth the energy expended to go that far, but than again, I suspect the lawyers don't expect any of us consumers to do a damn thing but shut up sit back and wait on their call. Truth, we only have power to stop this foolishness if we do something about, take a stand. If not, do what the lawyers expect you to do stfu and wait till they tell you otherwise.

I never received a verification letter requesting a receipt. I thought if the claim was less than $200 you would not need to send then a receipt. I had purchased 4 pairs, myself, 2 daughters and my sister, but didn't have receipts of course. Who keeps them once you have given the item to someone and it fits?!?! So my claim was under the $200 so hopefully I will see a little of it at least. Hope everyone else gets treated fairly with this. I will post when I receive a check, if I get one that is!

I called and was told that checks would be issued the end of April, and that they should be received within two weeks. She also stated if you received a verification letter and did not respond they would either deny you or reduce the amount of your claim. You will not be notified either way, you will get a check or you won't according to the representative.

Just called and spoke to a gentleman at 3:39 cst, he stated they are doing the final audit of all claims, but they have no date as of yet. Not sure what SEAN is talking about.

Hello, I never received a letter asking for proof of purchase. I just called and spoke to a very nice lady and she said checks are projected to go out by the end of this month (April). Maybe someone else can call and ask when they are planning to be mailed out and see if that person tells the same information.

I also received the letter asking for documentation.. ..(which I only submitted 2 pair of purchased shoes). I just called the 866 # and the gentleman said that they had received my information (which I mailed 03/11/2013) and were processing my claim. Just give it a little time and they will get a reply/reimburse ment to you.

I GOT THAT SAME LETTER FROM SKETCHER. HOWEVER THEY DID THE ADJUSTMENT AND I STILL GOT MY SETTLEMENT. HOPEFULLY NEW BALANCE DOES THE SAME THING. IF NOT SHAME ON THE LAWERS. THEY WILL GET THERE PAY WE KNOW THAT MUCH.

DougB, go read the agreement AND the Claim form again as they clearly outline what you are asking and the need to submit proof is on the claim form, in bolded print. Sadly, I submitted under $200 but jjusssst squeaked by it and they want proof. I paid cash, don;t have proof anymore but I did look up the current prices and they were the ballpark I recalled paying. SO no biggy, more for you guys I suppose; who needs shoes anyhow when you can;t walk, right?

Almost ALL consumer class action settlements contain language that sets forth what type of proof of purchase is required. In this case is was $200 or more. If there is more claims then dollars set aside, the amount should be adjusted until each claim gets some reward. But in this case they are going to disallow any claim without proof and refuse to pay. There should be a class action against the attorneys that hare handling this case.

The members of this class action need to bring a class action against the attorneys that are handling this case. The original agreement was that no proof of purchase was required for under $200. Now they are disallowing any claim regardless of amount.

I had purchased 2 pairs, but have NOT recieved a letter stating to show proof of purchase at this time. So hopefully its just a mix up and they will get it all squared up and everyone will get their checks cause I was really counting on this one. We will see, be positive and keep your fingers crossed : )

yes wanda but the claim form did have in bold print that if you had over 200 in claims, you had to have proof and if it was under 200 you might need to have proof if the amount in claims was more than the settlement amount. hard time are everywhere so more & more people are filing claims in these class actions, real claim or false claims, the claims administrators need proof. I mean seriously. people should send in claims and then proof as if it was being presented to a court of law to be hear for found in their favor. I mean, who goes to court expecting saying "because I said so and I am not lying" to prove and win their side? No one. And written documentation is what the Claims Administrator goes by, what the court requires as proof, not word-of-mouth.

Hey guys this is not right we bought about 9 pair
for our selfs an grandsons no more shoes for us after my grandson got hurt from them
but it's o.k. to take our money an now we can't even get most of it back due to anything over 200.00 you have to have proof that is so wrong
an ask for proof 1st of all we don't do checks an credit cards even debit card, they was all payed for by cash at different times you do remember cash people do still carry it due to identity theft debit an credit cards can cause problems for you so you are asking for proof still after all this time has went by i am not a hoarder if i was maybe i could fine a receipt maybe a shoe box
wrong to do folks like that we work hard for are money to but to all who gets a check enjoy it an i am glad you a least got one
come on treat us right you want our business
well we still do buy shoes but they want be new balance after this i want give them anymore of my hard worked money

plus the claim form said that if you had over $200 in purchases, then you had to have proof of purchase but it also said the if there were more in claim then funds available, the New Balance Class Action Settlement Administrator could request proof of purchase.

As further specified in the Settlement Claim Procedures and Claim Calculation Protocol, the Claim Form shall advise Class Members that the Class Action Settlement Administrator has the right to request verification of the purchase of Toning Shoes, including, but not limited to, receipt(s) or other documentation demonstrating purchase of any and all of the Toning Shoes during the Class Period. Looks like it was a form letter sent to ??Everyone??. Even though we purchased about 8 pairs, we knew we didn't have receipts from that long ago, so we only claimed 3 pair...but still they want receipts. Wow, unbeliveable

I received that same letter also, these lawyers are ripping us off big time, who do they think have receipts this far back and if you did they still would have something to say. The print would not even be legible on the receipt. They're just wasting our money on postage.

I received a letter requesting a receipt, I don't have a receipt for these purchases. They must know that everybody does not keep receipts for previous purchases especially if they were made over a year ago.
