Fiber Composites LLC has agreed to settle a class action lawsuit that alleges some of its composite decking products were susceptible to mold and fungus growth, and that the company failed to honor its warranty and pay for the decking to be replaced or repaired. If you purchased certain Fiberon, Veranda or Portico decking materials, you could be eligible for benefits from the class action settlement.
Who’s Eligible
Class Members of the Fiberon composite decking settlement include all persons residing in the United States who own residences or commercial buildings with a deck constructed of composite decking, railing or fencing material sold under the brand or trademarks Veranda Composites Decking, Veranda Traditions Composite Decking, Veranda TD Composite Decking, Fiberon M Pro Series Composite Decking, Fiberon Tropics, Fiberon Classic Composite Decking or Portico Composite Decking, and purchased or installed it there after March 12, 2008. Commercial properties located within 500 feet of water are excluded from the class action settlement.
Potential Award
Under the Fiberon decking settlement, there are three levels of benefits available to Class Members.
Tier 1: Each Class Member who has a deck constructed with one of the Fiberon composite decking products and has dark spotting on at least one-third of the deck due to mold, mildew or fungal growth and submits a timely and valid Claim Form will receive a voucher for a sufficient amount of cleaner for the deck.
Tier 2: If the spotting reappears after proper use of the cleaner, Tier 2 will provide Class Members who timely submit a Supplemental Claim Form with a sufficient amount of composite deck stain for the deck.
Tier 3: If after the proper application of the stain, the spotting bleeds through the stain and is generally visible, Tier 3 will provide Class Members who timely submit a Supplemental Claim Form with a voucher for a 23 percent discount for replacement Veranda Armorguard Composite Decking.
Proof of Purchase
Class Members must submit photographic or video proof that their Fiberon deck has spotting due to mold, mildew or fungal growth over at least one-third of the decking, despite cleaning. Class Members must also submit proof that they own the property on which the Fiberon product in question is located, proof of purchase and installation of the Fiberon product between March 14, 2008 and Sept. 4, 2013.
Claim Form Deadline
6/9/14. Tier 2 claims are due 150 days after the Tier 1 voucher is sent. Tier 3 claims are due 150 days after the Tier 2 voucher is sent.

Case Summary
The Fiberon decking class action lawsuit was filed in 2012 and alleged that certain composite decking materials manufactured and sold by Fiberon had a latent defect that manifested as dark spots due to mildew, mold or other fungal growth. Fiberon denies the allegations and asserts that the problems with the composite decking were the result of environmental issues, failure to properly maintain and clean the decking, or other issues excluded from warranty coverage. However, Fiberon has agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

My fiberon decking installed on 6/18/14 is buckling in about 7 areas of the deck.
The representative at fiberon said this is a contractor problem , not the material. I disagree. She was going to replace the boards and then abruptly changed and said no to all request for help.
I need help to replace and reconstruct this deck.
I am 88 years old and I think they are taking advantage that I will not persue an rightful outcome.
Paid for a floating dock installation and the fiberon decking got stain all over and the surface started to pit over the year .I was told that using this product that was guaranteed to last for 20 plus years.The surface is soo rough and has to be scrub yearly because of the mold and stains. Would like to know if there is anything that can be filed against fiberon manufacture??
