Bear Naked class action lawsuit

Bear Naked Inc. has reached a class action settlement over claims it falsely labeled some of its food products as “100% Natural” or “100% Pure & Natural.” If you purchased certain Bear Naked food products on or after Sept. 21, 2007, you could be eligible for benefits from the Bear Naked class action settlement.

The plaintiffs in the Bear Naked class action lawsuit alleged that they purchased Bear Naked food products based, at least in part, on the allegedly misleading statements printed on the products’ labels that the products were “100% Natural” or “100% Pure & Natural.”According to plaintiffs, the Bear Naked products contained synthetic despite these representations.

The plaintiffs alleged they relied on the labels when making their purchases and believed that the products contained no synthetic ingredients. According to the Bear Naked class action lawsuit, they would not have purchased the products or would have purchased less expensive non-natural products if they had known the Bear Naked products contained synthetic ingredients. The Bear Naked class action lawsuit was certified on July 30, 2013.

Bear Naked denies that it did anything wrong and asserts that its labels were truthful and consistent with the law. However, according to court documents filed May 2, the company has agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The parties have indicated they will ask the court to preliminarily approve the Bear Naked class action settlement on May 27.

Who’s Eligible

Class Members of the proposed Bear Naked class action settlement include all California residents who purchased Bear Naked’s food products on or after Sept. 21, 2007 in the State of California that were labeled “100% Natural” or “100% Pure & Natural” but which contained Hexane-Processed Soy ingredients.

The class action settlement includes the following Bear Naked products:

  • Heavenly Chocolate Granola
  • Peak Protein Original Granola
  • Peak Energy Cranberry Almond Trail Mix
  • Peak Energy Chocolate Cherry Trail Mix
  • Fruit & Nut Soft-Baked Granola Cookies
  • Double Chocolate Granola Cookies
Potential Award

Class Members who can present written proof of purchase may seek reimbursement of $0.50 per package for every product purchased during the Settlement Class Period. Class Members without proof of purchase may seek reimbursement of $0.50 per package for every product purchased during the Settlement Class Period, with a maximum recovery of $10 per household.

Proof of Purchase

None required. However, claimants without proof of purchase will only be eligible to receive a maximum of $10 per household.

    Yesterday 1-2-15 I received a check from Bear Naked a rebate check in the amount of $18.69 good day great way to greet the new year.

    The deadline to file a claim was August 25, 2014. The Court granted final approval of the Settlements on September 2, 2014. Checks were mailed to eligible Class Members who filed a valid Claim Form on December 30, 2014.
