Talbots class action settlement

Consumers who opened a Talbots brand credit card account between June 2012 and February 2013 may see a check in the mail soon thanks to a class action lawsuit settlement approved last week.

U.S. District Judge Paul A. Engelmayer approved the Talbots credit card settlement after a May 21 Fairness Hearing, calling the deal “fair and reasonable.” The class action settlement resolves allegations that Talbots Classics National Bank and The Talbots Inc. violated the Truth in Lending Act (“TILA”) by failing to include certain disclosures in their account-opening materials for Talbots store credit cards. This omitted information included, among other things, certain information pertaining to potential billing disputes – information that credit card issuers are required to provide under TILA.

Talbots denies any wrongdoing but agreed to a $595,000 class action lawsuit settlement in order to avoid the expense of going to trial. The Talbots settlement resolves all claims asserted in the class action lawsuit, including all claims related to credit card account-opening disclosures. The Talbots class action settlement also resolves claims against Comenity Bank, the current issuer of the Talbots brand credit card.

Consumers who opened a Talbots credit card account and first used the account between June 18, 2012 and Feb. 25, 2013 will automatically receive a check for approximately $3.70. There is no need to file a claim. Settlement checks will be mailed approximately 14 days after approval becomes final, according to Court documents.

Who’s Eligible

Class Members of the Talbots credit card class action settlement include all persons who opened a Talbots branded credit card account and first used the account between June 18, 2012, through and including Feb. 25, 2013.

No proof necessary. Awards will be distributed based on Talbots’ records.
