Cinepolis FACTA settlement

Cinépolis Luxury Cinemas in California has reached a class action lawsuit settlement over allegations its credit/debit card receipts contained too much information in violation of federal law. If approved, Class Members can claim up to $10.75 from the Cinépolis class action settlement.

The Cinépolis Luxury Cinemas settlement resolves a class action lawsuit accusing the movie theater of violating the Fair and Accurate Credit Transaction Act (FACTA) by printing too many credit/debit card numbers on customers’ receipts. Cinépolis denies any wrongdoing but agreed to settle the case to resolve the litigation and avoid the expense of going to trial.

A California federal judge granted preliminary approval to the Cinépolis FACTA class action settlement on June 4. A Final Fairness Hearing is scheduled for Aug. 11.

Who’s Eligible

Class Members of the Cinépolis FACTA settlement include all persons who made a credit or debit card purchase at a Cinépolis California theater between July 1, 2011 and June 30, 2013, and received an electronically printed receipt that contained more than the last five digits of their credit or debit card number.

Potential Award

Up to $10.75  in the form of a Settlement Certificate sent by e-mail. The Certificate will be redeemable for one small popcorn of certain flavors or a small fountain drink or both at any Cinépolis Luxury Cinemas.

Proof of Purchase

Class Members that received an email notice of the Cinépolis FACTA settlement do not need to provide proof of purchase; they will automatically receive a Settlement Certificate if the class action settlement is approved.

If you did not receive an email notice, you must request to be a Class Member and provide a copy of the receipt from Cinépolis issued between July 1, 2011 and June 30, 2013 containing more than the last five digits of your credit or debit card. To be added as a Class Member, you must send proof by e-mail to admin@cinepolisfactasettlement.com, or mail to CinepolisFACTASettlement, PO Box 43034, Providence, Rhode Island, 02940-3034.
