Details: This could be a BIG chunk of cash back to you IF you qualify to make a claim in this class action lawsuit settlement. First things first. Are you included in this settlement? The terms are below. We’ll break it down a bit, Top Class Actions style, after we list the terms below:

 

If you, between April 5, 1996 and December 30, 2008, meet the following criteria:
(a) were insured under a personal lines automobile insurance policy providing uninsured motorist property damage coverage or underinsured motorist property damage coverage (hereinafter collectively referred to as “UMPD” coverage) issued by Nationwide;
(b) were involved in an accident with an underinsured, uninsured, or hit and run motorist and reported this type of claim between April 5, 1996, and December 30, 2008;
(c) for whom the sum of claim payments made by Nationwide under any property damage coverage for vehicle repairs exceeded $1,000;
(d) whose vehicle was less than six years old at the time of loss;
(e) whose vehicle had less than 90,000 miles at the time of loss; and
(f) whose vehicle suffered structural (frame) damage and/or required body work.

 

However, claims that fit within any one of the following categories are NOT included in the Settlement:
(a) claims resulting in total losses;

 

(b) claims for damage to leased, non-owned or temporary substitute vehicles;
(c) claims limited to (i) glass repair or replacement; (ii) tire replacement, or (iii) sound systems repair or replacement, or (iv) any combination of (i) (ii) and (iii) only;
(d) claims identified as closed without payment by Nationwide;
(e) claims in which the policyholder was paid for diminished value in addition to the cost of repair;
(f) claims involving vehicles that, prior to the accident at issue, had been involved in any other accident; and
(g) the Nationwide Entities, all present or former officers and/or directors of the Nationwide Entities, Class Counsel, the Judge of this Court, the Judge’s family, Nationwide’s counsel of record, and all Persons who make a timely and valid election to be excluded from the Settlement Class in accordance with the provisions of the Individual Notice and/or Summary Notice.

 

So, what’s this mean? If you are or were a Nationwide auto insurance policy holder and were in an accident caused by an underinsured motorist, uninsured motorist or a hit and run accident between 4/5/96 and 12/30/08 and your car had body or frame work completed on it, and the claim exceeded $1,000 and your car was less than six years old and had less than 90,000 miles on it AND it wasn’t a total loss (totaled) you’re likely able to make a claim. Essentially the Plaintiffs claim that they should have received more money than they did because once your vehicle is in an accident it loses value, even if it is fixed and looks pristine. They feel you should be paid for that loss of value in your claim in addition to the cost to fix the car when you’re not at fault in the accident. OK, got that? Onto the claims process.

 

Head to the Settlement Administrator Website and click on “Documents” in the menu at the top then “Claim Form.” It’s EXTREMELY important that all information is filled in. If you miss anything your claim will likely be challenged or outright denied. Fill out your name, address, and phone number. Now fill out the date of the accident, make and model of your car involved in the accident, and your claim number. If you don’t remember it, give Nationwide (or your insurer) a call and ask them for help. They’ll have the information for you. Now, onto the all important questions. FAILURE TO ANSWER ANY OF THE QUESTIONS WILL LIKELY RESULT IN YOUR CLAIM BEING DENIED!

 

You must answer “Yes” to either question 1 or 2 or both for your claim to be proceesed. If you answer “No” or “Don’t Remember” to both your claim will likely be denied.

 

You must answer “Yes” to questions 3, 4 and 5 for your claim to be processed. REMEMBER, this information is in your claim so lying about it won’t help. If you don’t remember, try to find out. If you still can’t find out, but feel confident your answers are “Yes” make sure to enter it. If you answer “No” or “Don’t Remember” to both your claim will likely be challenged or denied.

 

Sign and date the claim form and send it in. That’s it! So, how much can you get? Here’s an example and the formula for figuring out how much you may receive:

 

Formula: ($35,750,000 – attorneys’ fees and costs awarded to Class Counsel [$9,710,000 in fees, Lead Plaintiff Rewards and Expenses ESTIMATE]) x (Individual Class Member Repair Cost / Total Repair Costs for All Settlement Class Members).

 

Original Repair Cost Claim: $4,000

 

Total Repair Costs for All Settlement Class Members: $20,000,000 (ESTIMATE)

 

Formula: $26,040,000 x ($4,000/$20,000,000 = .0002) = $5,208 Class Action Lawsuit Settlement Reward!

TCA Staff Tidbit: At first glance I wasn’t too enthused about this settlement. Then I read through it. WOW! This could be a BIG win for those who can make a claim RUN, DON’T WALK to the post office and send in your completed claim form. As you can see in our example above someone with a mid-size claim could walk away with thousands of dollars. If even less people make their claim then your personal reward will only increase. That’s GREAT! I also think this is a really great case for the consumer and makes a LOT of sense. If someone slams into your car, can’t pay for the damage and you get it repaired should you have to take the EXTRA hit in the loss in value of the car? I think not. We pay a whole lot of money every year for our insurance and I think we should get something out of it when we need it. I’m very curious as to how many more of these class action lawsuit settlements we’ll see from the other big insurers. I GUARANTEE you they’re coming and we’ll cover them here at Top Class Actions.
