comScore

A settlement has been reached in a class action lawsuit alleging comScore Inc. collected information from consumers’ computers through its data collection software without getting their consent. If you had comScore’s software downloaded and installed on your computer at any time since 2005, you could be eligible for benefits from the comScore class action settlement.

The privacy class action lawsuit alleged comScore used certain versions of its data collection software (called RelevantKnowledge or PremierOpinion) to unlawfully collect information from consumers’ computers. If you downloaded and installed RelevantKnowledge or PremierOpinion, you most likely did so through one of comScore’s bundling partners. Bundling partners are individuals or companies who distribute their own software for free over the internet. Through an agreement with comScore, these entities have “bundled” comScore’s data collection software with their downloadable software, and you may have been asked to install comScore’s software.

ComScore has agreed to pay $14 million into a class action settlement fund, which will be distributed on a pro rata basis to Class Members who submit valid and timely Claim Forms. Under the terms of the privacy class action settlement, comScore has also agreed to take certain steps to modify its disclosures and the process for obtaining consent for the download and installation of its data collection software.

ComScore denies the allegations but has agreed to settle the privacy class action lawsuit to avoid burdensome and costly litigation.

Who’s Eligible

Class Members of the comScore class action settlement include all individuals and entities in the United States and its territories who had comScore’s data collection software downloaded and installed on their computers via a bundling partner, and used their computer in interstate commerce and/or communication.

Potential Award

Up to $11,000, depending on how many Class Members submit valid claims for the comScore class action settlement. The payment will be an equal share of the amount available in the Settlement Fund. It is estimated that, based on the expected rate of claims, each Class Member who submits a valid Claim Form will receive approximately $200.

Proof of Purchase

N/A. Class Members must provide information under the penalty of perjury about why they believe they are eligible for benefits from the comScore class action settlement. Class Members must also be able to provide the email address they used when comScore’s software was installed on their computer.
