Petersons Nelnet fax spam settlement

A proposed settlement has been reached in a class action lawsuit alleging Peterson’s Nelnet LLC violated the Telephone Consumer Protection Act (TCPA) by sending fax advertisements.

Peterson’s Nelnet is a company that offers a variety of online products and services, including test preparation, financial aid searches and career search tools. The TCPA class action lawsuit alleges Peterson’s Nelnet sent fax advertisements (or caused them to be sent) in violation of the TCPA and certain Federal Communications Commission (FCC) regulations. Peterson’s Nelnet denies any wrongdoing but agreed to settle the class action lawsuit to resolve the allegations and compensate eligible fax recipients.

Under the terms of the TCPA class action settlement, Peterson’s Nelnet has agreed to pay $2.6 million to Class Members who submit valid Claim Forms.

Who’s Eligible

Class Members of the Peterson’s Nelnet class action settlement include: “All persons or entities who, from January 3, 2007 through January 3, 2011, was sent or caused to be sent one or more facsimile advertisements by Defendant, its employees, agents, vendors or contractors.”

Potential Award

Maximum cash payment of $500 per fax to Class Members who submit actual copies of faxes from Peterson’s Nelnet. Claimants who submit an affidavit or declaration will be eligible for a maximum cash payment of up to $275, depending on the number of faxes received.

Each claimant will be entitled to a single cash payment. If the TCPA settlement fund is insufficient to cover all valid claims, the payments may be reduced on a pro rata basis.
