Details: The Acer memory settlement will resolve a class action lawsuit (Wolph v. Acer America Corp.) that claims certain Acer Notebooks contain 1 GB or less of RAM to be shared between the operating systems and the graphics, which is less than Microsoft’s requirements that a computer have more than 1 GM of RAM in order to properly run the Vista Premium OS. The plaintiffs claim that as a result of this insufficient system memory, Acer’s Notebooks suffered from freezing, crashes, lock-ups and other poor performance.

Acer denies any wrongdoing but has agreed to a class action lawsuit settlement to resolve the litigation.

Class Members of the Acer class action settlement include all U.S. residents who bought a new Acer Notebook that came pre-installed with a Microsoft Windows Vista Home Premium, Business and/or Ultimate operating system, which contained 1 GB of RAM or less as shared memory for both the system and graphics, and have not returned the Notebook for a refund.

The Acer Notebooks covered under the class action lawsuit settlement include some, but not all, of the computers with the following model numbers:

As a Class Member, you’re entitled to receive one of the following benefits from the Acer computer class action settlement (each Class Member can only get one benefit):

  • A 16 GB USB Flash Drive with ReadyBoost technology;
  • A check for $10;
  • A check for up to $100 as reimbursement for Class Members who, before April 25, 2013, paid for Notebook performance repairs in an effort to resolve performance problems due to RAM; or
  • A compatible 1 GB or 2 GB laptop memory DIMM for Class Members who still own their Notebook that will allow the computer to operate with 2 GB of RAM.

The only way to receive one of these benefits is to submit a valid Claim Form postmarked no later than July 24, 2013.

A Final Fairness Hearing is scheduled for October 4, 2013. Benefits will not be paid until the settlement becomes effective and all objections are resolved.

    Any new updates? I was never requested to provide additional information (which I have available to send at any time). I spent $600 in this ACER ASPIRE at Staples and nobody is going after Staples for selling and not recalling defective products. I also spent $125.00 in shipping charges to ACER USA and I have not recuperated a penny yet. I request a response to my inquiry as well a response concerning if you need additional support information. My ACER Aspire’s hardware died after 6 months and ACER Aspire USA’s Customer Support is the worst in the universe since they require to send the ACER ASPIRE for repair in a brand new box and with different size bubles to be able not to assume any responsibility. If you do not respond soon, I will like to assign my case to a different law firm. I hope to hear from you soon. Thanks for your cooperation since it is more than 1 year waiting for your response after sending 2 CLaim Forms via Certified Mail to your office.

    mine crashes constantly I had to put linux on it just so it would run for more then 5mins without a bsod Aspire 5720Z

    My wife just reminded me that the computer came with Windows Vista pre-installed, and it froze from the time we bought it.
