First National Bank Overdraft Class Action Settlement

A federal judge has approved a $3 million class action settlement between First National Bank and customers who say they were charged improper overdraft fees. Class Members will automatically receive an account credit or check if they incurred one of these fees.

Who’s Eligible

Class Members of the FNB overdraft settlement include all customers who had a First National Bank of Pennsylvania checking or demand deposit account that they could access with a debit card and who incurred an improper overdraft fee between June 1, 2006, through and including February 8, 2013.

Potential Award

Varies. The amount of money you will receive from the FNB overdraft class action settlement will be based on how many Class Members there are and how much money they paid in improper overdraft fees.

Claim Form Deadline

There is no claims filing process; current account holders will automatically receive their portion of the class action settlement deposited to their accounts. Former account holders will receive a payment via mailed check.

Case Summary

The FNB overdraft settlement resolves a 2012 class action lawsuit (Ord v. FNB Corp.) that alleges the bank reordered debit and credit card transactions from highest to lowest dollar amount to increase the likelihood that customers would overdraw their accounts and trigger overdraft fees. This practice violated its customer contract, violated state unfair trade practices laws, and resulted in unjust enrichment, according to the class action lawsuit.

FNB denies any wrongdoing but agreed to refund customers through a class action lawsuit settlement fund to resolve the litigation.
