The manufacturer of Nasal Ease nasal spray has reached a class action settlement over claims it falsely advertised that Nasal Ease temporarily relieves allergy symptoms. If you purchased Nasal Ease in the United States between April 1, 2010, and Feb. 25, 2014, you may be eligible to claim a full refund of your purchase with proof of purchase or up to $15 cash without a receipt.
The Nasal Ease settlement resolves a class action lawsuit (Hoover v. Hi-Tech Pharmacal Co. Inc.) that alleges Nasal Ease was advertised as being able to relieve allergy symptoms such as sneezing, sinus congestion and runny nose. Plaintiffs in the class action lawsuit contend that Nasal Ease’s ingredients have never been scientifically proven to be able to treat allergies or their symptoms, and therefore Hi-Tech’s advertising statement were false and misleading.
Hi-Tech denies the allegations but has agreed to set up a class action settlement fund to compensate consumers and resolve the litigation. The class action settlement was preliminarily approved Sept. 27, 2013. A Final Fairness Hearing is set for March 24, 2014. Claims will not be paid until the settlement is Effective and all appeals are resolved.
Who’s Eligible
If you purchased Nasal Ease nasal spray in the United States between April 1, 2010, and Feb. 25, 2014, you can claim a cash refund from the class action settlement.

You may be eligible to claim a full refund of your purchase with proof of purchase or up to $15 cash without a receipt.
Proof of Purchase
Claims submitted with proof of purchase in the form of a receipt will entitle you to a full refund of the amount(s) shown on the receipt. If you don’t have proof of purchase but swear under penalty of perjury that you purchased Nasal Ease during the timeframe listed above you may submit a claim for $5 per product with cap of $15 per household.
