Details: If you are a current resident of the United States and you purchased Department Store Cosmetics in the United States during the period May 29, 1994 through July 16, 2003, which cosmetics were manufactured, distributed and/or sold by one of the Manufacturer Defendants or Department Store Defendants, you will be eligible to receive, while supplies last, free Department Store Cosmetics, with an approximate retail value of $18 to $25 per unit, that were manufactured and/or sold by one of the Manufacturer Defendants. THAT'S IT! No claim form to fill out online. You will have to sign an affidavit stating you purchased the affected products when you pick them up from the store, only one per person. The giveaway is scheduled to take place starting on January 20th, 2009 and lasts for seven days or until the store runs out of product. It appears that each store in the chains below will receive at least SOME of the product listed. Keep in mind that quantities will be VERY limited and no rain checks will be offered. Once they're out, you're out of luck.

Class Action Lawsuit Settlement Amount(s): $175,000,000 in free cosmetics to be given away. $24,000,000 will go to the lawyers. No, I don't think they're being paid in cover-up and perfume. ;)

TCA Staff Tidbit: This is an OLD settlement which is finally coming around to being paid out. It's a doozy in the amount of stuff being given away, but first come, first served! Keep that in mind! I'm sure that each store which advertises the the giveaway will be a MADHOUSE the day it opens up. We listed what you can get for free starting on January 20th, 2009 in the Details section. $175,000,000 sounds like a lot of cosmetics, but when you think about them being spread out all across the country each store will have a limited amount. Hopefully this will be a benefit to all of the ladies out there who should be able to pick up some make-up. See the details above for what's being given away and where.

This was a real sham. Customers that have spent thousands of dollars were given a few items to choose from and all were marked "Not for sale. And you received one item.  These are promotional items given during cosmetic sales.  Younkers and others have the charge receipts, they could have checked to see who bought what.  There was a much better way to do this.

I have had 2 strokes and couldn't get to the store.  I went to Nordstroms & Neimans for years all my purchases were recorded on my store credit cards.  I don't think this was the best plan.

I often shop for these products, but not like my aunt.  Neither one of us knew that we could get a free item for all the money we have spent.  An acquaintance of hers told hers (that may have bought something once) got a full sized bottle of face cream yesterday just because she cut through Dillards to get to Verizon, yet we got nothing.  That is unfair to those of us loyal users of specific brand.  Who can we contact to complain??

i live in vegas & had shopped at this fancy stores all my life for cosmetics & fragrances. i am totally appaled that the items that they were giving away were all samples & not for sale products. more worst than that are the attitude of these salespeople, most of them are rude!!! when i went to nordstrom, i was just barely getting in line & this guy just rudely accused me of getting the product already & i should then leave. what a jerk!

Just so everyone knows, these products are labeled "Not for Sale" they are giving away the free products that they get to combine with gift sets etc.  It is not really worth the waste of gas to even go in for your free trial sample.  Where is the reprocussions for their actions? They get punished by giving away product that was not intended for sale anyway.  Defeats the purpose of hitting them in the pocket book where they hit us.

I went to Dillards last night and was given a very short list of items left.....I chose a shower gel and when I got home it was marked on the box - free sample, not for resale.....was it the idea of the store to get rid of items they had left over from holiday and could not get rid of?

Was that the actual idea of the lawsuit?

i think this could have being handled differently.  i think the people that work in these stores to;d their friends and family, which why it was such high turnover right away.  how are the people who are hanicapped, without transporation or the people who shop online supposed to take advantage of this.

I am a loyal customer of Nordstrom's and have purchased Lancome and Estee Lauder for years.  I was not notified of the settlement and when I found out from a friend, it was too late.  The stores ran out of products within a few hours.  Is there anything I can do?  I don't think that this was handled properly.  I would expect that many of the recipients of the handouts were not even customers.  The lines I heard went for a block to get into the store.

I was wondering if saks off the rack, dillards closeout store and other outlet stores are giving away cosmetics as well? The only mall near me with those stores is Arizona Mills which has mostly outlet versions of stores.
I am a single working mom.  I live in North Dakota and the nearest department store to me is almost 90 miles away.  I am simply unable to come in and take part in the give away.  I have purchased both Lancome and estee lauder products in the years stated for this class action suit.  There are others who are disabled or for whatever other reasons are unable to make it to a store.  There should be an alternative method as well so all who have purchase product from these particular retailers are able to receive thier product from the give away!  Also because it is a first come first serve, what about those that work and cannot make it in until later in the day.  Was this really all that well thought out?!

ANYWAYS I SPENT SO MUCH AND STILL DO I CANT BEGIN TO TELL YOU ALL THAT I PURCHASED FROM THEM DURING THAT PERIOD AND VERY EXPENSIVE AND LOVE LANCOME PRODUCTS STILL BUY ARMANI, ETERNITY,,DIOR,MY GOODNESS SOOOOO MANY BUT YET I CANT SHOW UP TO GET ANYTHING FROM THEM AND NOW I LIVE IN LOUISVILLE BECAUSE OF HUSBANDS MOTHER 82 AND ALZHEIEMRS . hE DOES ALL THE SHOPPING NOW AND I HAVE TO SHOP ONLINE SO ANY ADVICE?????????? CAN U LET THE COMPANY KNOW I STILL HAVE RECEIPTS FROM 1991 TO THE PRESENT IN BOXES STILL. SO WHAT DO I DO?? THANK YOU TERESA

In general, all that's necessary to make a claim for this particular class action lawsuit settlement, is to show up at the store on January 20th (preferably early since quantities will be limited) and make your claim. We assume there will be signs directing people to the correct area to make your claim but we haven't been informed of what preparations are taking place at the stores to notify the employees of how to deal with the settlement. It should be pretty simple. The claimant shows up, signs a form stating they bought the merchandise during the purchase window, picks their item from the list (keep in mind they'll only carry products from the list that they actually sell at the store, if they don't sell it, it won't be there) and heads home. Easy as that.

i knew notin about this and am very bothered because in 2003 i shopped at both dillards and target mostly target for my eye shadow lip gear and mascara woooooooooooo can i please find out what its all about
