Generic Zoloft Manufacturers Immune From Lawsuits, Congress Fights To Make Them Culpable
By Scott Hardy
Parents of children filing birth defect lawsuits alleging Zoloft caused persistent Pulmonary Hypertension (PPHN), Atrial Septal Defects (ASD), ventricular septal defects (VSD), abdominal birth defects (omphalocele), cranial birth defects (craniosynotosis), aorta coarctation, hypoplastic right or left heart syndrome, transposition of the great arteries (TGA), tetralogy of fallot (TOF), spina bifida and club feet may run into major problems if they took the generic version of Zoloft. The supreme court ruled in 2011 that generic drug manufacturers are not responsible for the warning labels placed on the boxes and pill bottles. What does this mean for parents of children who were born with birth defects which may be because of Zoloft or another antidepressant? It may mean that suing the manufacturer of the generic drug is a waste of time. It's one very important reason why you should always speak with a birth defect attorney. Only an attorney who works Zoloft or SSRI antidepressant birth defect cases can determine if you have a case that is worth pursuing.
The good thing is that congress is actively working to change this law. A new bill in congress would allow consumers to sue generic drug manufacturers if they weren't warned of a potential severe side effect. It's been alleged in dozens of lawsuits that SSRI antidepressant drugs like Zoloft and Paxil cause severe birth defects if taken while pregnant like Persistent Pulmonary Hypertension (PPHN), Atrial Septal Defects (ASD), ventricular septal defects (VSD), abdominal birth defects (omphalocele), cranial birth defects (craniosynotosis), aorta coarctation, hypoplastic right or left heart syndrome, transposition of the great arteries (TGA), tetralogy of fallot (TOF), spina bifida and club feet. It's critical that congress passes the new bill which would protect Americans right to pursue generic drug manufacturers if they suffer injury from an unpublished side effect of their prescribed drug.
Zoloft and antidepressant birth defect lawsuits typically allege that Pfizer, and sometimes Zoloft distributor McKesson Corporation, should have warned pregnant mothers of the risk of taking Zoloft while pregnant. Zoloft birth defect lawsuits often include references to a study that Pfizer performed which showed that Zoloft could cause birth defects in but didn't warn patients taking the drug of their findings. Pfizer conducted animal trials which found that Zoloft caused severe side effects in animal fetuses. Typical Zoloft birth defect lawsuit state that even though Pfizer knew of the risk of birth defects Pfizer did nothing to warn doctors and patients of the risks inherent in taking Zoloft while pregnant.
Antidepressant SSRI medications are alleged to cause serious and severe birth defects like congenital heart defects, low birth weight, still birth or babies were born with PPHN. Thousand of parents are expected to file lawsuits against Pfizer to help pay for medical treatment and pain and suffering which their children have endured to fix or treat Zoloft related birth defects.
Some parents who have had a baby born with an alleged Zoloft birth defect have opted to file a Zoloft birth defect class action lawsuit. Filing a Zoloft birth defect class action lawsuit may not be in the best interest of everyone. It's important that those affected by alleged Zoloft side effects speak with a qualified Zoloft attorney to determine their best course of action which may be filing an individual lawsuit against Pfizer. If your baby was born with a birth defect and you were taking Zoloft, another antidepressant SSRI drug like Paxil, or another medication, you should speak with an experienced birth defect attorney. Ideally congress will pass the bill allowing consumers to sue generic drug manufacturers for failing to properly warn patients of undocumented side effects. This would potentially open the door to thousands of consumers suing generic drug manufacturers for damages to cover medical treatment and pain and suffering.
