Injured Victims Seek Biomet Metal Hip Implant Lawsuit Consolidation

Biomet hip implant lawsuit Victims injured by Biomet M2A Magnum hip implants filed a motion with the Judicial Panel on Multidistrict Litigation last month asking that all federal Biomet hip injury lawsuits be joined together in one court, before one judge. If approved, the new Biomet lawsuit MDL could make it easier for Plaintiffs to secure a lawsuit settlement to compensate them for injuries caused by failed M2A Magnum hip devices.
 
Biomet has been the subject of numerous metal-on-metal hip implant lawsuits filed by patients who were injured by M2A Magnum hip replacement devices that prematurely failed. Plaintiffs in Biomet hip implant lawsuits are alleging an array of injuries from the all-metal M2A Magnum, including having to undergo revision surgery to replace the failed device. Evidence suggests that metal-on-metal hip implants like the Biomet M2A Magnum are failing at a rate higher than standard hip implants, and are exposing patients to risks due to the metal-on-metal components depositing metal particles into the surrounding tissue and in the blood stream, causing irritation, inflammation, metal poisoning, tissue death, bone loss and pseudotumors.
 
Over the past three years, there has been a significant increase in adverse reports to the FDA involving the Biomet M2A Magnum hip replacement system. According to some Biomet hip implant lawsuits, more than 350 reports of adverse events associated with the M2A Magnum hip system have been filed with the FDA to date. Adverse events associated with the Biomet M2A Magnum included reports of acetabular cup loosening, metallosis (blood poisoning), osteolysis (bone loss), necrosis (tissue death), chronic pain, popping, squeaking and pseudotumors.
 
Adverse event reports are often underreported to the FDA, however, which means the number of people harmed by the Biomet M2A is likely substantially greater. 
 
If approved, the new Biomet hip implant lawsuit MDL will make it easier for some Plaintiffs to sue Biomet for manufacturing and selling a defective device, and for failing to warn patients about the risks associated with receiving a metal-on-metal hip implant. An MDL allows thousands of Plaintiffs to file their lawsuits under the jurisdiction of one judge, but still retain their own attorney and secure their own individual settlement based on their individual circumstances. The MDL judge oversees the cases and ensures there is unified (and not duplicate) discovery, which can mean a faster and more effective process for reaching a hip implant lawsuit settlement. The MDL judge may even encourage early test trials known as bellwether cases to determine the strengths and weaknesses of their cases, as decided by a jury. Those test cases often allow the hip implant lawsuits to settle en masse
