The Yaz wrongful death lawsuit was filed by Plaintiff Chad Zipperer, who claims his wife, Brandy, was unaware of the risks associated with Yaz when she began taking the oral contraceptive. Brandy died from a Yaz stroke on April 3, 2007 after suffering “pain and mental anguish” from her injuries, the Yaz lawsuit states. Zipperer states in the lawsuit that Brandy was “a good wife, mother and provider” prior to her untimely death, which left him with not only a broken heart and empty spot in his life, but also left him with huge medical and funeral expenses. Zipperer and his Yaz attorney allege Bayer did not adequately warn the public about the side effects of Yaz, including pulmonary embolism, deep vein thrombosis and stroke, and in fact did quite the opposite: “urging” women to use Yaz and Yasmin as a safe option for birth control. Through the Yaz lawsuit, Zipperer wants Bayer to pay up for its negligence, which he says directly contributed to his wife’s death.
Zipperer’s Yaz wrongful death lawsuit, filed in the U.S. District Court, Southern District of Illinois, will join the Yaz lawsuit MDL currently pending there. Zipperer is one of hundreds of Plaintiffs seeking compensation for injuries caused by Yaz side effects, including Yaz stroke, pulmonary embolism and deep vein thrombosis. Nearly 12,000 Yaz lawsuits have been filed on behalf of 14,000 Plaintiffs who have been injured by Yaz and its close cousin Yasmin. The majority of these lawsuits have been consolidated into the federal Yaz lawsuit MDL in Illinois, where Zipperer’s lawsuit was filed.
Bayer has already settled hundreds of lawsuits pending in the Yaz lawsuit MDL. To date, more than 700 Yaz lawsuit settlements have been reached, totaling $142 million in compensation for the Plaintiffs. The average Yaz settlement so far is about $218,000 per Plaintiff.
The Bayer Yaz lawsuit settlements are far from over, though. Presiding Judge David R. Herndon recently requested a settlement mediator to oversee the Yaz settlement negotiations, which means Bayer will likely settle even more Yaz side effect lawsuits. The mediation efforts will allow Plaintiffs to negotiate Yaz settlements in the hopes of avoiding lengthy litigation and jury trials.
