Oak Ridge Cleanup Workers File Asbestos Lawsuit

Mesothelioma asbestosA group of six Oak Ridge cleanup workers have filed an asbestos lawsuit claiming they were lied to more than a decade ago about the safety of a job they were contracted to do with a government electric facility in 2000-2001. The workers allege in the asbestos lawsuit that they were exposed to asbestos, PCB and other toxic chemicals while removing condensers from the facility and demolishing them. The Plaintiffs claim they were told the condensers contained no toxins, poisons or asbestos, and that their requests for respirators and other protective equipment were refused by the government contractor teams. The workers’ asbestos lawyer says they were intentionally deceived, putting them at risk for life-threatening asbestos illnesses, such as mesothelioma — a rare cancer caused by exposure to asbestos dust. They are seeking damages from a number of government contractors who were involved in the cleanup operations at the Department of Energy’s K-25 plant in Oak Ridge, Tennessee.

 
The workers allege in the asbestos lawsuit that their current medical complications are caused by asbestos exposure and PCB exposure on the job, and that they’ve been exposed to an increased risk of developing cancers like mesothelioma in the future. The six men worked as independent contractors for R&R Electric Corp., a subcontractor that was involved in the demolition of “synchronous condensers” at the K-25 Oak Ridge site, which was part of a $300 million DOE project that dismantled and decontaminated three uranium-enrichment facilities. According to their asbestos lawsuit, the workers were exposed at the Oak Ridge site to asbestos dust, PCB dust and other hazards while cutting up the condensers with chop saws.
 
“The chop saws created thick clouds of find dust and debris, which completely coated Plaintiffs’ bodies and clothing every day, and which they breathed continuously,” the asbestos lawsuit says.
 
The workers also allege they were exposed to smoke from fires in 2000 when the government contractors attempted to burn insulating material and wrapped off the large copper coils that had been removed from the condensers to salvage the copper.
 
“The coils were burned in open fires in the BNFL switchyard over a period of a week, creating huge plumes of smoke,” the asbestos lawsuit states. “On information and belief, the insulting material and wrapping contained significant quantities of ACM (asbestos-containing material) that was distributed through the site.
 
According to the asbestos lawsuit, contractors denied knowledge that the equipment contained asbestos, despite the fact that they had access to Department of Energy manuals confirming that the condensers did contain asbestos.
 
The workers, with the help of their asbestos attorney, are seeking unspecified compensation for pain and suffering, increased risk of cancer, mesothelioma, and other asbestos-related diseases. Individuals can contract mesothelioma and other asbestos illnesses by breathing in asbestos dust while removing items from facilities, or even by washing the clothes of someone who has been exposed to asbestos. As a result, even the Oak Ridge workers’ family members are at risk for contracting mesothelioma.
