A Texas jury has awarded an $8.4 million asbestos mesothelioma settlement to the widow of a man who died from asbestos exposure while working at a Dow Chemical plant run by Ashland, Inc. subsidiary Hercules, Inc. The mesothelioma settlement is believed to be the first asbestos verdict reached against Hercules, and may set the precedent for similar asbestos mesothelioma lawsuit cases.
The mesothelioma lawsuit was filed on behalf of John Gensler, now deceased, and his wife Martha Gensler. During the three-week asbestos lawsuit trial, Gensler’s asbestos attorneys were able to prove that Hercules knew it was exposing John and other workers to toxic asbestos pipe products throughout the late 1960s and early 1970s, but failed to warn them. Hercules continued to hide the asbestos danger from workers even after the government began requiring warning labels be placed on products containing asbestos in 1971, the asbestos lawsuit claimed. To make matters worse, Hercules used pipes that contained up to 10-times the amount of asbestos as other similar asbestos pipes.
“Hercules has a documented history of environmental contamination and corporate malfeasance,” said the Gensler’s mesothelioma lawyer. “While other asbestos pipes contained around three to five percent asbestos, Hercules’ asbestos-containing pipes were 50-percent asbestos, an amount found to be highly dangerous to people and the environment.”
Mrs. Gensler sued the companies for failing to adequately warn her husband about the health hazards of working with asbestos, for failing to provide him with adequate protective gear, and other charges.
