Five New Plaintiffs File Yasmin/Yaz Lawsuit Over Blood Clot Injuries
By Andrea Gressman
Women who have suffered Yasmin, Yaz, Beyaz or Ocella blood clot injuries are urged to speak with a compensation specialist right away to see if they have a case to join the Yaz MDL and hopefully secure compensation through the millions of dollars in Yaz lawsuit settlements Bayer is currently offering.
The five Plaintiffs who requested to be added to the Yaz lawsuit MDL took the contraceptives and experienced Yaz side effects such as pulmonary embolism, dangerous blood clots and gallbladder problems between 2006 and 2012.
According to their Yasmin/Yaz injury attorney, the women suffered “significant harm, conscious pain and suffering, physical injury and bodily impairment, including but not limited to suffering from pulmonary embolism, blood clots and/or gallbladder removal surgeries, and related sequelae requiring hospitalization, recovery therapy, continuing treatment and medical monitoring, which may have caused permanent effects, and which may continue in the future to cause physical effects and damage.”
Of the five women, two suffered a need for gallbladder removal surgery, three were diagnosed with pulmonary embolism, and one was diagnosed with Yaz blood clots. Their symptoms were all consistent with the known side effects of Yasmin, Yaz, Beyaz, Ocella and other oral contraceptives made with the synthetic hormone drospirenone.
Based on their suffering and Yaz blood clot injuries, the women are petitioning to be added to the group trial proceedings for the Yaz lawsuit MDL.
The women jointly claim that the responsibility for their Yasmin blood clot injuries and Yaz blood clot injuries rests with Bayer, the drug maker. They blame the drospirenone they ingested for causing their medical problems and insist that the company should have done a better job of informing patients of the risks when marketing Yasmin and Yaz. According to their Yaz/Yasmin lawsuit, Bayer “knew or should have known that the use of Yasmin and Yaz created a higher risk of blood clots than other oral contraceptives on the market, including but not limited to second generation oral contraceptive, and that, when taken as directed, such use was unreasonably dangerous to consumers.”
With the help of their Yaz injury lawyer, the women are suing Bayer for defective manufacturing, defective design and formulation, failure to warn, failure to adequately test, negligence, breach of warranties, and more. They are requesting compensatory, punitive and exemplary damages, as well as medical and legal expenses, through a Yaz lawsuit settlement.
The Yaz Lawsuit MDL
In the Yaz lawsuit MDL against Bayer, Plaintiffs allege the manufacturer knew – or should have known – that the birth control pills increased the risks of blood clots. As a result, instead of being presented as a safe option for contraception and the control of hormonal acne, the medication’s risks should have been more clearly advertised to both patients and doctors. Since it was not, Plaintiffs allege that the company failed in its duty to warn patients about the correct risk level of the medication and should be liable for damages.
The U.S. District Court in the Southern District of Illinois is where the Yaz lawsuit MDL is being held. Chief Judge David R. Herndon has appointed Stephen Saltzburg, a George Washington School of Law professor, as the Yasmin/Yaz lawsuits’ Special Master. This means the Saltzburg will act as a mediator for the Yasmin and Yaz lawsuits in the MDL. His job will be to work with both sides to help them agree upon a Yaz settlement so the case does not have to go to an actual trial. Appropriately, the court deadlines have been extended to allow time for this process to occur.
The History of Yaz Blood Clot Lawsuits
Yasmin and Yaz is a popular oral birth control pill line designed and manufactured by Bayer Pharmaceuticals. The effectiveness of the drug is tied to its use of the synthetic hormones drospirenone and ethinyl estradiol. These hormones make the birth control unique in the market and help identify its effects in the bodies of those to whom it is prescribed.
The synthetic hormones used in Yasmin, Yaz, Beyaz and Ocella have been linked to complications for some patients. They can cause blood clots and changes in overall cardiac health, which may lead to pulmonary embolism and strokes. In other cases, the medication has been linked to issues with gall bladder health, requiring gall bladder removal. These complications can be dangerous and life-threatening.
