Actos Bladder Cancer Class Action Lawsuit Filed in Canada
By Andrea Gressman
A new twist in Actos lawsuit proceedings regarding the diabetes drug’s link to bladder cancer has arrived with the filing of an Actos class action lawsuit in Canada. Previously, most of the Actos bladder cancer lawsuits were based in American courts. However, this new entry into the prosecution against drug maker Takeda Pharmaceuticals expands the scope of the trials to include other major drug markets. Victims of Actos bladder cancer are urged to speak with an Actos compensation specialist to see if they have a case to file an Actos lawsuit or Actos class action lawsuit in the U.S.The Actos bladder cancer class action lawsuit against Takeda was filed in the Superior Court in Montreal. The lead plaintiff in the Actos class action lawsuit is Jimmy Whyte, a Canadian resident who was given Actos to treat his diabetes. Whyte makes it clear in his Actos class action lawsuit that it is brought on behalf of all Canadian patients who may be suffering from bladder cancer as a result of using Actos to treat their existing diabetes issues. Hundreds of U.S. Actos bladder cancer lawsuits are also pending, seeking compensation for American Actos users.
According to Whyte’s Actos bladder cancer class action lawsuit, the manufacturer is being sued for failing to warn patients and their doctors about the risk of developing bladder cancer from taking the drug. Like many Actos bladder cancer lawsuits filed in the United States, it states Takeda knew or should have known about the risk of developing bladder cancer after long-term use of the drug. Numerous U.S. Actos lawsuits cite a 2005 animal study conducted by Takeda prior to FDA approval that showed Actos caused bladder tumors. Despite knowing this risk, Takeda failed to warn the public or place this risk on the drug’s label. It wasn’t until August 14, 2011 – when the FDA mandated it – that Takeda finally updated the Warnings and Precautions section of the Actos label to warn patients about the risks of Actos bladder cancer.
Health Canada made a similar label change on April 19, 2012, after a safety review revealed that patients using Actos for more than year increased their risk of bladder cancer. Another recent Actos bladder cancer study published in the Canadian Medical Association Journal found that Actos increased the risk of bladder cancer by 22%. This is in stark contrast to study findings by the FDA that showed long-term Actos use increases this risk by 40%.
Following the label changes, hundreds of Actos bladder cancer lawsuits were filed as patients became more informed about the possible causes of their bladder cancer.
