New Rulings Give Vaginal Mesh Implant Victims Have More Time to Sue

By Andrea Gressman

Vaginal mesh implant lawsuitVictims of vaginal mesh implant injuries will now have more time to sue implant manufacturers thanks to new rulings by the federal judge overseeing the multidistrict litigation (MDL) for ongoing vaginal mesh implant lawsuits. Presiding Judge Joseph R. Goodwin, who is overseeing multiple vaginal mesh lawsuits, has shifted the discovery requirements for vaginal mesh implant lawsuit Plaintiffs and Defendants. Both sides will want to be attentive to the new deadlines and requirements.

Vaginal Mesh Implant Lawsuit Ruling Details

Judge Goodwin made two new rulings on the vaginal mesh implant lawsuit proceedings in August 22 and 23, 2012. In his rulings, he laid out four new court orders related to the transvaginal mesh lawsuit discovery process for pre-trial and deadlines for the vaginal mesh implant lawsuit trials themselves.

The first order gives more time for Plaintiffs involved in the in vaginal mesh implant lawsuits against C.R. Bard. Trials for those transvaginal mesh implant lawsuits were originally set to begin in February 2013, but will now be held on June 24 2013. This allows more time for victims of vaginal mesh side effects and injuries to seek out vaginal mesh lawsuit attorneys to be added to the MDL and for full discovery to take place.

The other three orders cleared up a bureaucratic point in the transvaginal mesh implant lawsuits. Plaintiffs can now fill out a standardized vaginal mesh lawsuit form for filing their grievances about vaginal mesh implant side effects they suffered. The forms are standardized by the manufacturer and will help Plaintiffs be assigned to the right vaginal mesh lawsuit MDL. A vaginal mesh implant attorney can help victims of transvaginal mesh side effects access this form and fill it out correctly to ensure they’re able to join the vaginal mesh implant MDL and hopefully obtain a settlement.

Vaginal Mesh Implant Side Effects Lead to Hundreds of Vaginal Mesh Lawsuits

Vaginal mesh implants, transvaginal mesh implants and bladder sling implants were distributed by multiple manufacturers as a tool in pelvic reconstruction surgery. The vaginal mesh was intended to be inserted as additional support for organs and muscle tissue weakened by trauma, infection, surgery or aging. However, for many patients the side effects of vaginal mesh implants turned out to be a health nightmare.

Plaintiffs in vaginal mesh implant lawsuit proceedings have revealed a broad litany of vaginal mesh side effect complaints against the transvaginal mesh implant manufacturers. The vaginal mesh implants failed to keep their shape in some patients, shrinking in size and destroying delicate pelvic tissue. For other patients, the transvaginal mesh implants failed to hold up as they were intended, becoming an additional burden to healing instead of an aid.

Still other patients experienced ripping and tearing side effects from the vaginal mesh implants. As a result, many patients found that they needed follow-up surgeries, additional hospitalizations, and extensive medication to suppress pain and infection. Some patients have even died as a result of their vaginal mesh side effects.

Due to the malfunctioning of a transvaginal mesh implant and the disappointment that the vaginal mesh implant failed to live up to the promises made by manufacturers, patients around the country have filed vaginal mesh lawsuits against the various transvaginal mesh implant makers. These makers included the following:

* American Medical Systems
* Boston Scientific,
* C.R. Bard
* Ethicon, a subsidiary of Johnson & Johnson.

The number of transvaginal mesh lawsuits prompted a consolidation of the vaginal mesh lawsuits into MDL hearings divided by manufacturer. The vaginal mesh MDL lawsuits are being heard by the same judge, Judge Goodwin.

These new rulings will help move the vaginal mesh MDL lawsuits to resolutuion. If you or someone you know has been negatively affected by vaginal mesh implant side effects, transvaginal mesh implant side effects or bladder sling implant side effect, don’t miss the window for being added to the vaginal mesh MDL proceedings.
