Propecia Sexual Dysfunction Lawsuit Added to Federal MDL

Propecia sexual dysfunctionAnother man alleging Propecia sexual dysfunction side effects has been added to the federal multidistrict litigation for Propecia lawsuits pending in the Eastern District of New York. The latest Plaintiff claims he was just 27 years old when he began taking the hair loss drug and developed sexual side effects from Propecia. He is now seeking a Propecia lawsuit settlement for the severe emotional distress his injuries have caused.

 
Plaintiff Brian Battistone alleges in the Propecia sexual dysfunction lawsuit, filed on August 31, 2012, that he began taking Propecia in March 2006 to treat his male pattern hair loss. Battistone claims he was unaware of the risks associated with the medication, including reports of permanent Propecia sexual side effects such as erectile dysfunction, impotence, loss of sex drive, and more.  After taking Propecia, however, he suffers from severe and ongoing Propecia sexual dysfunction that has caused significant emotional and physical pain, and has required medical treatment for depression and anxiety. With the help of his Propecia lawyer, Battistone is seeking a Propecia lawsuit settlement from Merck for negligently breaching its duty to warn the public about the risks of Propecia side effects.
 
Propecia Sexual Dysfunction Is Not “Rare,” as Merck Once Claimed
 
Many men like Battistone are suing Merck for misleading them into believing that Propecia sexual side effects are rare and reversible after discontinuing use of the medication. Warnings of possible sexual side effects were included on the drug’s warning label, but Merck downplayed these side effects as “rare,” and stated they would go away once the medication was stopped. Unfortunately, for many men, this has not been the case, and reports of prolonged Propecia sexual dysfunction prompted the FDA in 2011 to require Merck to update the drug’s warning label to warn patients that Propecia sexual side effects may be “persistent or permanent.”
 
This new warning came too late for Battistone and many others who are now left with permanent injuries caused by Propecia side effects. Like Battistone, many of these men are turning to Propecia injury lawsuits to hold Merck accountable for claims of fraud, negligence and strict liability.
 
Many of these Propecia lawsuits are being consolidated into multidistrict litigation known as the Propecia lawsuit MDL (No. 2331) in the District Court, Eastern District of New York. The Propecia lawsuit MDL is similar to a Propecia class action lawsuit, but will allow Plaintiffs to retain their own lawyers and secure individual Propecia lawsuit settlements based on their individual injuries. A Propecia class action lawsuit settlement, on the other hand, would be shared equally among all Class Members.
