Leaked Memo Key to GranuFlo/NaturaLyte Lawsuits Against Fresenius Medical Care

GranuFlo recall lawsuitKidney dialysis patients who were given GranuFlo or NaturaLyte during their hemodialysis treatment may have a case to file a class action lawsuit or individual GranuFlo lawsuit against Fresenius Medical Care following the announcement that FMC knew as early as 2011 that the products were linked to dangerous side effects but failed to warn the public, medical community or the Food and Drug Administration.

An internal memo leaked to the FDA shows that top executives at Fresenius Medical Care knew that GranuFlo and NaturaLyte were responsible for hundreds of heart attacks and strokes in kidney dialysis patients receiving treatment at FMC clinics across the country. According to the memo, dated November 4, 2011, over 940 patients suffered GranuFlo heart attacks and NaturaLyte heart attacks, leading to multiple deaths. The memo said the problem needed to be “addressed urgently,” yet FMC did not contact the FDA or warn the public until the memo was leaked in early 2012.

On March 29, 2012, after reviewing the memo and investigating its claims, the FDA issued an immediate recall of GranuFlo and NaturaLyte. Now, an estimated 125,000 patients who received GranuFlo and/or NaturaLyte during kidney dialysis treatment are left wondering if they were serious harmed by the recalled products. Unfortunately, some of these patients have already died from heart attacks, leaving family members of kidney dialysis heart attack victims wondering if GranuFlo or NaturaLyte was to blame.
