Husband Joins Wife in NuvaRing Pulmonary Embolism Lawsuit Against Merck

NuvaRing pulmonary embolismA husband and wife have filed a NuvaRing lawsuit against Merck & Co. over injuries the wife sustained from NuvaRing side effects. The wife is seeking damages for a bilateral pulmonary embolism caused by NuvaRing blood clots. The husband is added to the NuvaRing lawsuit to seek damages for “loss of consortium,” or the loss of marital enjoyment from his wife as she continues to need medical care for her injuries. Loss of consortium damages can amount to thousands of dollars for spouses of injured loved ones.

 
Plaintiffs Deborah Payne and Eric Nelson allege in the NuvaRing pulmonary embolism lawsuit that Deborah used NuvaRing from approximately 2004 to October 2010 as a birth control method. On or about October 23, 2010, Deborah suffered a bilateral pulmonary embolism — a sudden blockage inside the lung artery caused by a NuvaRing blood clot that travels from the leg to the lung. Almost 70 percent of pulmonary embolism cases result in bilateral pulmonary embolism, or a blockage in both lungs. Deborah’s NuvaRing attorney contends Merck failed to adequately warn the public about the increased risk of NuvaRing blood clot side effects such as pulmonary embolism, and that Deborah would have chosen a different birth control method if she had known these risks. Deborah and her husband are seeking a NuvaRing lawsuit settlement to cover her medical expenses as well as to compensate her for her pain and suffering, and for Eric’s pain and suffering due the lost consortium of his wife.
 
Merck Failed to Warn of NuvaRing Side Effects 
 
Deborah and Eric join numerous other Plaintiffs filing NuvaRing injury lawsuits against Merck for not only failing to warn about the side effects of NuvaRing, but of also misrepresenting that the contraceptive device is safer than other birth control methods.
 
Merck marketed, promoted and advertised NuvaRing as having less of a risk of thrombotic side effects than other means of contraception because of its relatively low amount of estrogen.  However, Merck failed to disclose that NuvaRing contains a very high level of a dangerous third-generation progestin that increases the risk of blood clots, which are responsible for thrombotic side effects.
 
Thrombotic side effects include a class of blood clot complications known as pulmonary embolism (PE) and deep vein thrombosis (DVT). Deep vein thrombosis occurs when a blood clot forms in the deep veins of the body. If this blood clot dislodges, it can travel through the body and block certain arteries, resulting in pulmonary embolism, heart attack, stroke and even death.
 
According to a 2011 report by the FDA, NuvaRing can increase the risk of dangerous blood clots by as much as 56 percent over birth control pills. A more recent study published in June 2012 by The New England Journal of Medicine found that women who use vaginal ring contraceptives like NuvaRing are up to three-times more likely to develop dangerous blood clots. 
 
More than 50 NuvaRing blood clot deaths have been reported, yet Merck failed to properly warn the public about this increased risk of NuvaRing blood clot side effects.
 
Damages Sought for NuvaRing Blood Clot Side Effects
