Yaz/Yasmin Lawsuit Claims Birth Control is Responsible for Woman’s Gallbladder Surgery

Yaz Yasmin lawsuit Bayer Corporation was named as the defendant in a new Yaz/Yasmin lawsuit filed on September 24, 2012 in Los Angeles County Superior Court. The plaintiff in the Yaz/Yasmin lawsuit filed a short-form complaint claiming that the surgical removal of her gallbladder was brought on by side effects from her use of the contraceptives Yasmin and Yaz. This Yaz/Yasmin lawsuit comes as one more blow against Bayer in a sea of organized filings.

Plaintiff’s Husband also Joins Yaz Lawsuit

The thing that sets the September 24, 2012 Yaz/Yasmin lawsuit apart from the others is that the plaintiff’s husband has filed jointly against the drug manufacturer, with the basis of his claim being loss of consortium.  That is to say that his argument hinges on the claim that the companies that manufacture and distribute the birth control pills failed in their duty to appropriately warn the public of the side effects of Yasmin and Yaz.  Between the plaintiff and her husband, they are seeking damages from 22 separate causes of action, which include negligence, deceit by concealment, breach of implied and express warranties, products liability claims and a colorful selection of California Business and Professions Code violations allegations.

Bayer Targets Younger Women but Fails to Warn of Yasmin Side Effects, Lawsuit Says

Yaz and Yasmin birth control were developed with women of childbearing age in mind and were marketed appropriately to reach that audience.  Yasmin, the precursor to Yaz, went on the market in 2001 followed by Yaz in 2008.  After spending some time on the market, it became known that these birth control pills had significant and occasionally life-threatening side effects that include the following:

* Stroke
* Pulmonary embolism
* Heart Attack
* Blood clots
* Deep vein thrombosis (DVT)

In this most recent Yaz/Yasmin lawsuit, gallbladder disease is being added to this list.  The use of Yaz and Yasmin has led to side effects resulting in permanent damage and death.

Bayer Increases Potential Yaz/Yasmin/Ocella Settlements to $1.29 Billion

 
Due to the sheer volume of claims and seriousness of Yaz/Yasmin side effects, Bayer reportedly expects to spend around $1.29 billion in Yaz lawsuit settlements. It should be noted, too, that women who have used the generic version of Yasmin and Yaz — Ocella — have also come forward and recently filed birth control lawsuits against the drug manufacturer.

Additional Claims Strengthen Yaz/Yasmin/Ocella Lawsuits

The organized approach to the Yaz/Yasmin/Ocella lawsuits really is to the benefit of the named plaintiffs as each piece of litigation adds weight to the “parent” Yaz/Yasmin/Ocella lawsuit. The parent Yaz/Yasmin/Ocella lawsuit provides the overall summary of the Yaz/Yasmin/Ocella lawsuit in totality against the defendants, but plaintiffs have been made aware that if they file separately but under this parent Yaz/Yasmin/Ocella lawsuit, their litigation will be advanced much more quickly than in a traditional class action lawsuit motion.

In that same document, Bayer went on to anticipate the overall expense of Yaz/Yasmin/Ocella lawsuit settlements to go above and beyond those already settled to cost the company up to $1.29 billion.

    I was a victim of yaz i had several bleeding for years i hsd a blood transfusion as well as a partial hysterectomi
    I was in and out of the hospital and bleeding for 6 months at a time. My number is 252 432 2610
