FDA May Limit Need for Vaginal Mesh Implant Failure Lawsuits
By John Curran
Vaginal mesh implant failures have affected women for years, and the federal Food and Drug Administration told one manufacturer to stop selling their transvaginal mesh implant more than five years ago. Now the FDA is finally expected to make it tougher for bladder sling implant manufacturers to get their products on the market. It is still in the early days. Vaginal mesh implant class action lawsuit lawyers will still continue to have more clients contact them, because it is only a preliminary vote. There is a smaller panel that advises the FDA on whether or not to reclassify medical devices because of risks, such as transvaginal mesh failures. They are telling the FDA to force additional testing before bladder sling implant products can go on the market.
It is a welcome development because part of the problem comes from the FDA going in the opposite direction. The agency has fast-tracked the approval of metal on metal hip implants as well as transvaginal mesh implants, using a standard of "substantially equivalent." Unfortunately, since vaginal mesh implant side effects and failures often come several years down the line, new classes of implants were approved before the designs of old ones were truly tested.
Going by the numbers, in just the three-year period ending 2010, 500 women per year had vaginal mesh implant failures that produced conditions bad enough to warn the FDA. The statistics have been so bad that primary care physicians and gynecologists have shied away from the products, or warned their patients about potential bladder sling implant failure risks. It may not help current patients facing vaginal mesh erosion and sharp pain, but it could be a step in the right direction.
