Chantix User Sues Pfizer Over Suicidal Side Effects

Ohio Plaintiff, Kym Stokley, claims Chantix was responsible for blackouts, depression, suicidal thoughts, and other psychological problems in a recently filed Chantix lawsuit. On September 12, 2012, Stokley adopted the master short form complaint for joining the Chantix lawsuit multidistrict litigation in Alabama’s Northern District, U.S. District Court. The Chantix lawsuit has since been added to the Chantix MDL.
12 Counts Brought Against Pfizer in Chantix Lawsuit
As recorded in the Chantix lawsuit against Pfizer, the manufacturer of the drug, the Chantix lawsuit plaintiff started using Chantix in 2009, and as a result began to suffer adverse side effects related to the drug, including the following:
* Depression
* Blackouts
* Suicidal thoughts
* Suicide attempts
12 counts are brought against the manufacturer in the Chantix lawsuit, including the following:
* Failure to provide adequate warnings
* Flawed design
* Breach of express and implied warranties
* Negligence
* Gross negligence
* Negligent misrepresentation and concealment
* Negligence per se
* Fraudulent misrepresentation and concealment
* Punitive damages
* Unjust enrichment
* Violations of state consumer fraud and deceptive trade practices acts

Black Box Warning Ordered by FDA
Back in 2006, Chantix was approved by the FDA; not long after approval, however, the FDA began receiving reports of adverse effect events involving depression and suicide in patients who have taken the anti-smoking drug. The FDA received almost 300 reports in a period of a year and a half stating such side effects. The agency gave an order to Pfizer in 2009 to include a black box warning to the Chantix label warning users of the potential risk for suicidal thoughts and depression.
Lawsuits Consolidated in Chantix MDL
The establishment of the Chantix MDL was made to combine similar Chantix lawsuit claims for the purpose of expediting the judicial process and making it more efficient for quicker summary judgments. Lawsuits, like the Chantix lawsuits, with similar allegations or accusations and evidence are often combined into a single multidistrict litigation.
Combination of the pretrial proceedings and discovery is established. However the Chantix lawsuits themselves are unique to each plaintiff and have their own verdicts, judgments, and awards. Plaintiffs desiring their Chantix lawsuits to be added into the MDL may adopt what is known as the master short form complaint, which incorporates all allegations and other important, relevant information found in the Master Consolidated Complaint for the Chantix MDL.
