$3.35M Settlement May Affect Future Vaginal Mesh Lawsuits

This was the first vaginal mesh injury lawsuit to go to trial with hundreds more pending. It is obvious that this first case will likely have a big impact on the future of vaginal mesh lawsuits and potential settlements.

The jury in the case has spoken loud and clear in the plaintiff’s favor. The jury at the Superior Court of Atlantic County in New Jersey awarded Ms. Gross $3.35 million in compensatory damages. This is a huge blow to defendants Johnson & Johnson and Ethicon, as well as all the other vaginal mesh implant manufacturers.

It is not clear what the actual ramifications will be from this settlement victory but it could be substantial for other plaintiffs across the nation. This could mean larger settlement payouts as vaginal mesh implant manufacturers do all that they can to avoid the courtroom. It could also mean vaginal mesh injury settlements will be reached quicker as they have gotten a clear view of what a jury’s stance may be.

This victory may also increase the overall number of cases filed. As this particular plaintiff receives national attention it is likely that more awareness will be brought forward regarding how dangerous these vaginal mesh implants can be and also provide reassurance to victims of mesh side effects that they too can receive the compensation they deserve for the injuries they sustained.

Vaginal mesh and bladder sling implants are frequently used to treat pelvic organ prolapse and stress urinary incontinence. However, the vaginal mesh has been known to actually harden, which causes scaring as well as inflammation in the tissue.

There are a number of very serious side effects that women experience when their vaginal mesh implant goes wrong. These include the following:

 

  • Erosion of vaginal tissue
  • Perforation of organs
  • Severe pain
  • Vaginal bleeding
  • Vaginal scaring


In Ms. Gross’ case it took 18 surgeries so far to correct the side effects her Ethicon vaginal mesh implant caused. This was likely a huge factor in the jury’s decision as there were reports that the jury stopped their deliberation to have her testimony read back to them.

Now that this first vaginal mesh lawsuit has gone to trial it is very important that those who have been victims of vaginal mesh side effects file their own lawsuit right away. This vaginal mesh settlement verdict could really encourage manufacturers to speed up the settlement process and you do not want to miss out on the compensation you deserve for the pain and suffering you have been forced to endure.
