New Wrongful Death Lawsuit Filed Over GranuFlo Recall

GranuFlo recall lawsuitThe side effects linked to the dialysis product GranuFlo have allegedly claimed another man’s life. Tanzella Leary has become the latest plaintiff to file a wrongful death lawsuit after her husband, Darian Leary, died from complications caused by receiving GranuFlo during his dialysis treatment. The lawsuit was filed on February 25, 2013 in the United States District Court, Northern District of Alabama — the same state where Mr. Leary resided before his death.

The death of Mr. Leary is not unique. GranuFlo and NaturaLyte have claimed the lives of hundreds of dialysis patients across the United States. According to the GranuFlo lawsuit, Mr. Leary experienced a heart attack that resulted in his death on February 28, 2011. The lawsuit claims that Fresenius Medical Care, the manufacturer of GranuFlo and NaturaLyte, made, marketed, and sold products that were dangerous to its users. They also charge Fresenius with negligence and failure to warn among other things.

Mrs. Leary has requested compensation for her late husband’s medical expenses, his funeral and burial costs, as well as compensation for the emotional injury, pain and suffering, and loss of enjoyment of life she suffered due to her husband’s death.

Like many of the GranuFlo and NaturaLyte side effect victims and their family members, Mrs. Leary had no idea that the dialysis products were linked to her husband’s death until they were recalled by the Food and Drug Administration (FDA) in March 2012.

Another claim that Mrs. Leary makes in her lawsuit is that Fresenius knew of the dangers that GranuFlo and NaturaLyte posed and chose not to make this information available to the medical community, dialysis patients or the general public. This claim is partially confirmed by an internal memo issued by Fresenius in November 2011 to clinics within its own network. In the memo it stated that there had been over 900 deaths in the past year that had been linked to GranuFlo and NaturaLyte.

This information was then leaked to the public in March 2012 where it made its way to the FDA. From there the agency started its investigation and issued a Class I recall later that month. Following the recall, the number of GranuFlo and NaturaLyte lawsuits has increased as people began to realize that the heart attack or other side effect that they or their loved one experienced was related to their dialysis treatment.

GranuFlo Side Effects

GranuFlo and NaturaLyte have been known to cause several different types of side effects. One of the most common is a heart attack, which can potentially lead to heart failure. However, there are a number of others that include the following:

  • Cardiac arrhythmias
  • Coma
  • Electrolyte imbalances
  • Hypotension
  • Stroke
  • Sudden death

    Is this lawsuit the same as the previous lawsuit that is still going on? I lost my mother to all the side effects and I have encountered monetary and emotional distress from my mother’s death.
