New Lipitor Lawsuit Alleges Drug to be Defective Product

Lipitor Diabetes LawsuitEvery day new lawsuits are being filed against Pfizer Inc. for their diabetic treatment drug Lipitor. Recently, Louisiana plaintiffs Howard and Jessie Lumar have filed allegations against Pfizer for injuries incurred while using Lipitor. Allegations in their Lipitor lawsuit include failure to warn consumers of the risks associated with their drug, negligence and fraud. 

Plaintiff Jessie Lumar was prescribed Lipitor in January 2011 to lower her levels of low-density lipoprotein and to lower her risk of developing cardiovascular disease. According to Pfizer, their own studies have shown that Lipitor does indeed reduce the risk of cardiovascular disease and it was because of these studies that Ms. Lamar decided to take Lipitor.

 
According to the Lipitor lawsuit, “Plaintiff was diagnosed with type-2 diabetes in or about August 2008. As a result, for the rest of her life she must undergo regular testing of her blood glucose levels, adhere to a restrictive diabetic diet, and take medication to control her diabetes. Due to her diabetes, she is now at markedly increased risk of heart disease, blindness, neuropathy, and kidney disease.” The Lumars are now taking legal action against Pfizer. 

Overview of Lipitor Diabetes Complications and Pfizer Inc. 

After Lipitor was approved by the U.S. Food & Drug Administration (FDA) in December of 1996, Pfizer began to distribute Lipitor throughout the United States in 1997. According to the Lipitor lawsuit, Pfizer had knowledge prior to their distribution that Lipitor ”is causally related to the development of type 2 diabetes and/or blood glucose levels diagnostic for type 2 diabetes” but still decided to sell it anyways all while promoting the drug as “safe and effective.”

 
While Pfizer did update the product label to indicate this risk, the company decided to provide minimal, vague language such as, “Increases in HbA1c and fasting serum glucose levels have been reported with HMG-CoA reductase inhibitors, including LIPITOR.” While that labeling may be sufficient for a chemist, most consumers cannot be expected to realize that the warning indicates an increased risk of developing type-2 diabetes.

The Lipitor lawsuit is Jessie and Howard Lumar vs. Pfizer Inc., Case No. 2:13-cv-05980-HGB-ALC, in the U.S. District Court for the Eastern District of Louisiana.

    took this medicine for 1 month, made me have cramps in my back

    I have been taking Atorvastatin (Lipitor) 40mg tablets for about 3 years. A few months later my blood sugar went up, so my doctor started me on Metformin, as she said that I am pre diabetic Type 2, which I had to stop after 3 months as I was sick from the bad side effects, so I started Glumetza which also made me sick, so the doctor finally put me on Januvia. I am also ow having problems with my kidneys.
