Husband’s Death Leads to GranuFlo Wrongful Death Lawsuit

Alice Cowart of Mississippi says that she and her husband had no idea that he was at a higher risk for NaturaLyte cardiac arrest side effects while undergoing kidney dialysis until several years after his death in 2010, allegedly due to defective kidney dialysis chemicals.
On September 27, 2010, Elliot Cowart went in for hemodialysis treatment at a local clinic and suffered from what his wife and GranuFlo lawsuit attorney now believe to be cardiopulmonary arrest caused by the chemicals. According to the complaint, he died the next day, and at the time, the Cowart family had no idea what caused his heart problems.
In 2012, the U.S. Food & Drug Administration (FDA) requested information from kidney dialysis chemical manufacturer Fresenius Medical Care, following the leak of a 2011 internal memo warning technicians at its own facilities of problems regarding both chemicals. The complaint alleges that officials at Fresenius knew of the increased likelihood of NaturaLyte cardiac arrest side effects, six to eight times higher than with other treatments.
More importantly, Alice Cowart and her GranuFlo lawsuit attorney allege that the cause of death in many of these cases, increased bicarbonate levels, was known to Fresenius officials who noted an increase in patients with that condition beginning in 2004. The company recommended that its own technicians lower the amount of either chemical used, but did not warn outside clinics like the one used by Elliot Cowart. NaturaLyte and GranuFlo were recalled in 2012.
As a result of her husband’s death and the alleged actions of Fresenius regarding GranuFlo side effects, the complaint seeks damages on counts of strict liability, negligence, failure to warn, breaches of various warranties, fraudulent misrepresentation and concealment, among others.
The GranuFlo wrongful death lawsuit is Alice Cowart, et al. v. Fresenius Medical Care Holdings Inc., et al., Case No. 13-cv-00209, in the U.S. District Court for the Southern District of Mississippi.
