Lawsuit Says Woman Got Type-2 Diabetes from Lipitor Side Effects

By John Curran

Lipitor diabetes side effects lawsuitA Tennessee woman alleges in a new Lipitor lawsuit that she had no idea that Lipitor side effects included elevated blood sugar levels, which can lead to type-2 diabetes. The plaintiff alleges she contracted type-2 diabetes two years after taking the drug and continued taking the popular cholesterol medication for more than a decade, unaware that Lipitor was the cause of her chronic illness.

Plaintiff Mary Holloway began taking the statin drug in August 1998, a few years after the medication first appeared on the market in an effort to lower LDL cholesterol levels and to reduce her risk for cardiovascular disease. According to her Lipitor diabetes lawsuit, she was diagnosed with what she later found out were Lipitor side effects in 2000 but was not aware of the risks of type-2 diabetes from Lipitor, so she continued to take the medication for 12 more years.

According to the Lipitor lawsuit, Holloway is now much more likely to suffer from heart disease or blindness as a result of her type-2 diabetes diagnosis. She says she would not have taken the medication had she known of the possibility of these Lipitor side effects. Even if she had been aware of the newest drug safety label update, however, the lawsuit argues it may not have been clear enough for her, as the label reads, “Increases in HbA1c and fasting serum glucose levels have been reported with HMG-CoA reductase inhibitors, including Lipitor.”

That does not clearly warn patients of the risks of diabetes, according to Holloway’s Lipitor lawsuit, because it does not clearly explain what elevated blood sugar levels can lead to.

The Lipitor type-2 diabetes lawsuit is Mary M. Holloway, et al. v. Pfizer Inc., Case No. 13-cv-00110, U.S. District Court, Middle District of Tennessee. Counts against Pfizer include failure to warn, negligence, fraud, unjust enrichment and loss of consortium for Holloway’s spouse, Eulus.

Women who have dealt with Lipitor side effects that lead to type-2 diabetes may have legal options available to them. There are already enough cases that Pfizer is coordinating with plaintiffs regarding pre-trial motions and discovery. If you have been diagnosed with diabetes, you may also be able to file a Lipitor diabetes lawsuit and pursue compensation.
