Specifically, these Harley-Davidson motorcycles have a design defect in the Japanese-made clutches installed in the bikes. This design defect involves lurching forward when starting in gear. Many operators start in gear, as instructed and intended by Harley-Davidson, when it is difficult for them to find neutral. . To start in gear, by design, the operator must pull in the clutch lever. This gives the operator the false sense of security that the engine has been completely disengaged from the transmission. However, particularly when these Harley-Davidson motorcycles are cold, sticking of the clutch plates can cause unexpected forward lurching of up to two feet. Although this is a known phenomenon, Harley-Davidson has made no effort to design it out, guard against it and no warnings are provided regarding the risk of forward lurching when starting in gear. This phenomenon occurs because the oil in the primary chain case causes the internal plates of the clutch to stick together. Particularly when cold, this sticking phenomenon prevents the clutch from fully disengaging the engine from the transmission. This can cause the Harley-Davidson motorcycle to lurch forward when started in gear. Due to the size and weight of the these motorcycles, unexpected forward lurching can result in loss of control resulting in death or serious injury. The class action law firm of Wasserman, Comden & Casselman, L.L.P. is currently investigating claims concerning defects in the Japanese made clutch installed in Harley-Davidson motorcycles. The lawsuit was filed by a professional pilot who was injured after attempting to start his Harley-Davidson motorcycle and the bike lurched forward unexpectedly, severely crushing his leg and foot. Because of this accident, the pilot is no longer able to fly. This example helps illustrate how dangerous the alleged product defect is and why it should be fixed before more people are seriously injured.  The lawsuit is not because of faulty American-made parts and will not impact American jobs. It is targeting the dangerous Japanese-made clutch which should be recalled and fixed so that Harley-Davidson bikes and their riders are not harmed. An American clutch maker (Eaton) has clutches on the market that would solve this problem. Once a Harley-Davidson rider loses control of the motorcycle, due to a faulty clutch, the motorcycle can crash causing hundreds or thousands of dollars in damage. If the rider fails to jump clear of the Harley-Davidson motorcycle he or she may not be able to keep the bike upright and could be crushed by the heavy bike.
Thousands of motorcycles with this dangerous, Japanese-made clutch defect are on the road. This needs to be resolved and the clutch needs to be replaced.
