Stephen King Texts Lead to Settlement

Yet another settlement regarding pesky text messages has popped up, this time regarding a text advertising the Stephen King VIP Mobile Club and his recent book “Cell.”
According to the lawsuit, some 60,000 cell phone users received these unsolicited text messages Simon & Schuster, King’s publishers. Interestingly, this class action suit was initially thrown out on the grounds that the plaintiffs had signed up to receive promotional messages from Nextones.com and agreed to “terms and conditions” that permitted cell-phone advertising. But the decision was reversed for two reasons: federal law prohibits the use of an automatic telephone dialing system, and Simon & Schuster is not a Nextones affiliate, as stated in the “terms and conditions.”
Instead of going to trial and risking up to $90 million in damages, the defendants have settled for $10 million. If you received a Stephen King text message in January 2006, you could be eligible to receive $175 under the settlement.
