Update from the President of TCA

Happy Saturday everyone! I hope you’re having a GREAT weekend! It’s breezy and in the 80s here in Phoenix so we’re enjoying the perfect weather while we can. Entirely too soon it will be 110 and HOT!Unfortunately it was a sad week for consumers.

The Supreme Court narrowly sided with big corporations, crippling the rights of consumers and employers. Our, mostly unbiased, take on the decision is here. My personal opinion is that it’s a great day to be a mega corporation and a very sad day to be an employee or consumer.  The bulk of the class actions we cover at TCA are consumer product lawsuits which aren’t impacted by the decision (for now) but we’ll have to see how things shake out.Congress and the House are currently working on litigation which would take back some of the rights that the Supreme Court just threw out. Our hope is that those are passed through quickly. What rights does a consumer have if they are overcharged $3 a month for 3 years illegally? If they can’t file a class action lawsuit, they’ll have an impossible time finding an attorney who will work on a contingency fee basis to battle for an $108 award. What about the employee that’s not paid for 30 minutes every day as they log in and out of their computer? Even if there are thousands of employees, they all must arbitrate the case individually now, again most times without an attorney. A sad day indeed!We’ll keep reporting on developments. In our discussions with attorneys in our network were informed about a number of different strategies that they’re moving forward on to save their firms. I think if you can weather this initial storm you’ll be in great shape as everything comes together next year.As I stated, the bulk of our business is consumer product class actions so we don’t expect to see much more than a small bump in revenue. But, just like everyone else in the class action industry, we’re looking at adapting to the new world and adding some new lines of business.
