Details: The proposed IPEX Kitec Plumbing class action settlement will resolve several class action lawsuits filed in the U.S. and Canada (collectively called In Re: Kitec Plumbing System Products Liability Litigation) that allege IPEX manufactured defective Kitec plumbing systems that prematurely fail, resulting in leaks or damage to the structures they’re installed in.
The Kitec class action settlement includes all persons that own, have owned, lease, or have leased a building, home, residence or any other structure in the United States and Canada that contains, or at any time contained, a Kitec Plumbing System (which may consist of components, individual parts, or as a system, PEX-AL-PEX, PE-AL-PE, PERT-AL-PERT, PEX pipe, valves, fittings).
You can see photos of the Kitec Systems here. There are also several ways to tell if you have a defective IPEX Kitec Plumbing System installed:
(1) The Kitec pipe is typically blue in color for cold water applications and orange in color for hot water applications.
(2) The pipe is usually marked with one of the following brand names: Kitec, PlumbBetter, IPEX AQUA, WarmRite, Kitec XPA, AmbioComfort, XPA, KERR Controls or Plomberie Améliorée.
(3) Where the fittings are visible look for the words Kitec or KTC on them. The terms CSA B137.9/10 or ATSM F1974 could also indicate that you have a Kitec system.
(4) Often, the best places to look for the Kitec system is near the hot water tank or in the mechanical room where the pipe is connected to or exits the walls. Also look under kitchen sinks or bathroom vanities, where the pipe and/or fitting exits the wall.
If approved, the IPEX class action lawsuit settlement will allow Class Members to share in the $125 million settlement to help pay for the repair of buildings, residences, homes or other structures plumbed with the defective Kitec Systems. The amount of compensation you will receive will depend on a number of factors, including the type and the cost of any property damage incurred.
To be eligible to receive compensation from the Kitec settlement, you must complete and submit a valid Claim Form within 8 years after the Effective Date. As of now, that estimated deadline is January 1, 2020. (Keep checking the Settlement Administrator’s website at www.KitecSettlement.com for updates.)
If you wish to exclude yourself from the Kitec settlement and retain your right to sue individually, you must submit your request by September 30, 2011.
Purchased or Leased From:Â This settlement includes all IPEX manufactured Kitec Plumbing Systems, regardless of when they were purchased or installed.
Claims must be postmarked by:Â 1/20/20 (estimated)

5 thoughts onU.S. & Canada IPEX Kitec Plumbing System Class Action Lawsuit Settlement
Hi,
We recently purchased a home in Austin and found out there is leak in the ceiling. We called the plumber and they said the Kitec pipes are leaking and has black mold growing within the walls. Are we able to submit a claim? It’s costing us almost $10,000.00 for repair and replacement.
Lawsuit is a waste of time, only people making money on it are the lawyers. Basically if you have a leak they will compensate you for having that repaired, it does not compensate you for any damage caused as you will have to go through your insurance company for that. The problem is much bigger, you need to have your entire plumbing replace as it’s likely you will have more leaks and more damage and you are not compensated for replacing the pipes or fittings, only where it breaks.
I’ve just had my first fitting fail after nine years and will be replacing everything with copper.
I find it hard to believe that Ipex continues to sell their garbage, except now it’s not Kitek so of course it must be much better. The $125MM they settled for in the class action is a joke, the only people that benefit in a class action are the lawyers and they are always eager to settle without going to court, a lot less work and more money for them.
My piping system is kitec IPEX installed in 2003. There is no leak or damage yet. Can I still be part of the claim? Thank you.
I am part of the claim but got a notice to provide damage costs. If I have not had damage -yet- can I still be part of claim. And; can I have plumbing removed and have costs covered before damage occurs?
Thanks
Hi
We are not sure if we qualify for this suit. We bought a very old house (1860’s estimate of build date), in 2004, and re-did all the plumbing in 2006 with Ipex. It was done by OPP (Ontario Provincial Plumbing), except, they never did finish hooking things up, which my husband completed. (That’s a whole different story !)
Could you please advice us if we should be filling in the forms, or if we even would come under these suits?
Thank you
Lynn
