Details: Blue Sky Natural Beverage Co. (n/k/a Monster Beverage Corporation) has reached a class action lawsuit settlement over allegations it deceptively marketed its Blue Sky sodas as if they were made in Santa Fe when, in fact, they were made outside of New Mexico. As a result, anyone who bought Blue Sky sodas between May 16, 2002 and June 30, 2006 can receive a 50-percent refund from the class action lawsuit settlement.
The Blue Sky soda settlement will resolve a class action lawsuit, entitled Chavez v. Blue Sky Natural Beverage Company, that accuses Monster Beverage Corporation of misleading consumers into believing its Blue Sky sodas are made in Santa Fe, New Mexico, through references on its cans, on its website and in its advertising and promotional materials. The class action lawsuit alleges these activities were false and misleading and violated state and federal requirements for the labeling of beverages.
The Defendants deny any wrongdoing, but have agreed to a class action lawsuit settlement to avoid ongoing litigation.
Class Members of the Blue Sky soda class action lawsuit settlement include anyone who purchased in the United States any beverage bearing the Blue Sky mark or brand between May 16, 2002 and June 30, 2006.
The Blue Sky soda class action settlement will provide all Class Members who submit a valid claim form a cash refund equal to 50 percent of the purchase price they paid during the Class Period, up to a limit of $100 per household with Proof of Purchase, or $6 per household without Proof of Purchase. Proof of Purchase means an itemized retail receipt that shows you purchased a Blue Sky beverage, the date, place and amount of purchase.
To receive a cash refund from the Blue Sky soda class action lawsuit settlement, you must submit a claim form no later than June 11, 2012. Claim forms can be downloaded online from the Blue Sky settlement website at www.BlueSkySodaClassAction.com.
