TCA Staff Tidbit: BSN N.O.-XPLODE BottleThe Bio-Engineered Supplements & Nutrition class action lawsuit settlement is interesting on a number of levels. First, users of their CELLMASS, NITRIX and N.O.-XPLODE products can claim up to $30 per person right up front. Second, they’re adding rebate forms to these products for the next two years (they’ll start showing up once the settlement is approved/closed on or around 10/19/09.) You’ll see rebates offered in the amounts of $3 per bottle of NITRIX, $3 per bottle of N.O.-XPLODE, and $5 per bottle of CELLMASS.  Consumers of their products can claim up to $50 in rebates per year.

BSN CELLMASS BottleSo what was this class action lawsuit all about? BSN listed on bottles of CELLMASS, NITRIX and N.O.-XPLODE a new form of creatine called “Creatine Ethyl Ester Malate”, or “CEM3”. The plaintiffs alleged that CEM3 is impossible to make and doesn’t exist. Once again dietary supplement manufacturers are allegedly fibbing on what’s included in the bottle. Cases like this one are what will lead the FDA to eventually start overseeing the dietary supplement industry. What do you think of this settlement? Do you think that the dietary supplement industry should be regulated? Please leave your comment below and let us know!
