Details: The Ameriquest mortgage class action lawsuit settlement includes all who originated their mortgage through Ameriquest or one of the other companies listed above. It's important to note that even though your mortgage may not be currently services by Ameriquest, if it originated through them you may be eligible to submit a claim. In addition, the Ameriquest mortgage class action lawsuit settlement combines more than a dozen individual cases into one large settlement. If your mortgage loan with Ameriquest originated after December 14th, 2001 you're likely included in the Ameriquest mortgage class action lawsuit settlement. The five classes included in this settlement are:

 

CLASS ONE: TILA RESCISSION CLASS

 

The TILA Rescission Class is a nationwide class of borrowers who at any time on or after February 8, 2003, (or, for residents of Massachusetts, at any time on or after February 8, 2002) have actually requested rescission in writing of their loans pursuant to applicable provisions of the Truth in Lending Act or state disclosure laws on or before December 1, 2009.

 

CLASS TWO: BAIT AND SWITCH CLASS

 

The Bait and Switch Class is a nationwide class of borrowers who meet one or more of the following criteria:
 
(i) loan records establish a final disclosed annual percentage rate that is at least 0.9% higher (as calculated pursuant to TILA) than the disclosed annual percentage rate (calculated pursuant to TILA) contained in preclosing written disclosures made to the borrower;
(ii) loan records establish that the borrower received a loan containing a prepayment penalty, but preclosing written disclosures made to the borrower described a loan without a prepayment penalty; or
(iii) loan records establish that the borrower received a loan containing a variable rate, but preclosing written disclosures made to the borrower described a loan containing a fixed rate.

 

CLASS THREE: DISCOUNT POINTS CLASS

 

The Discount Points Class is a nationwide class of borrowers who either entered into loans (i) made after December 14, 2001, and before February 3, 2003, on which they had to pay discount points in any amount; or (ii) made on or after February 3, 2003 on which they had to pay at least three discount points.


CLASS FOUR: WHOLESALE BORROWER CLASS

 

The Wholesale Borrower Class is a nationwide class of borrowers who paid an amount constituting more than 3% of their funded loan amount in settlement charges to Ameriquest or a mortgage broker.


CLASS FIVE: LOAN SERVICING CLASS

 

The Loan Servicing Class is a nationwide class of borrowers who paid Ameriquest default and delinquency fees or costs in an amount in excess of a total of $1,000. These fees and costs include fees listed in Ameriquest’s records as late fees, legal fees, phone pay non sufficient fund (NSF) fees, bad check non sufficient fund (NSF) fees, appraisal fees, inspection fees, and recoverable corporate advance fees.

ameriquest mortgage, What a bunch of thieves. My wife and i were ripped off in 2005 and lost our new home due to there fraudulant schemes.This is what happens when good people try to do the right thing and ameriquest keeps raising your payment each month. We found a lot lies in our contract with them. Sadly we found out after we signed the contract, now my credit has been ruined and we are both disabled and that sucks. Cant wait for these people to meet Saints Peter @ Paul

The stress I went thru was the worst of my life..I hoped that no one had to go thru what I went thru with this company.. but I found out after reading similar stories online that there were a miriad of different stories, varied in content. It made me sick to read them. It still hurts to this day to bear to think of what they did to me, and it's been 4 years now. I originated my loan at the end of 2003. God Bless everyone of you for having to cross paths and bear this company. Maybe someday the Lord will bless us all with some kind of redemption or a comparible.

I was going thru a divorce, I had cancer, shingles, and they knew all this and it didn't matter to them, it just made it easier for them to take advantage of me. Which is exactly what they did. I couldn't find a lawyer even in the yellow pages that advertised litigation for suing a Mortgage Company. They don't want to take on the big wigs by themselves as an individual and by the time they were willing it was too late. THERE WAS A CLASS ACTION, The company was dissolved.. you can't get blood out of a turnip.. they told me. I lost so many things, personal items, heirlooms, things that can't be replaced, home equity that they lied to me about went thru cruel, unbelievable treatment, they bulldozed over me and never looked back.

After reading the individual class cases, I fit into Class 1, because I had requested a rescission in writing of the loan because of the way they had changed my interest rate after I signed..and they knew I was looking for another lender. I still had to wait 6 mths to get someone else to re-finance. or a year.. can't remember exactly.. they foreclosed before I had time. I fit into Class II, the bait and switch, and Class four and Class Five. So I was more than qualified. They shunned me the whole way and did me absolutely as dirty as they possibly could. When I looked back on my loan papers.. some of the pagesweren't even filled out/in. Not disclosing everything to me, very inefficient documentation.

I lost my kids baby albums.. precious heirlooms.. but the weird thing is they didn't take any furniture in my house, only in my attic and garage.. and they kicked my garage door in. In the beginning, they sent me a check for 368.00 and asked me to decline the lawsuit, I refused and a lawyer online who heard my story, got me in. But when the summer of 2010 rolled around. all I got was a check for 72.00 and a letter telling me that was all I qualified for.

At this point there had been no eviction notice. Also, a number of expensive itemswere taken that were never returned, because by the time the supervisor had spoken to this guy, he couldn't lay access to my property, and many items were taken to the city dump. I went to the city dump and reclaimed valuable family photos, clothing, collectibles, toys of my daughters. But things like, jewelry, electronics, etc.. were no where to be found. I never got them back. even afterwards when they knew what was going on, and still no eviction notice, I would pack things up into boxes and leave my home a few hours and come back.. and they'd be gone. There was no stopping this company by this point. They got to where when I would call, they would avoid speaking to me. I couldn't leave my house to move things without them stealing something. This may seem odd to some of you, but it actually is the honest to God truth.

because the company was in California and no one knew as of yet what was really going on. After losing all this equity, including being treated criminally.. unfair business practices etc.. I noticed when I wasn't home things started disappearing from my house.. I called police and filed reports, I thought they were possibly local burglary cases. Then, my dad caught them in my driveway with a truckload of things, and when he asked them who they were, they claimed they were hired by Ameriquest but wouldn't give their names. They took off without my dad being able to catch them or get a tag number. After calling the mortgage company and complaining. and speaking to a girl named Jennifer and her supervisor.. they admitted that it was someone in the retention department that wasn't authorized to verbally carry this out and admitted that it was criminal.

I had contacted the insurance commissioner and the Attorney General in my state about their illegal practices. They promised me relief and payments to be back to what we had agreed on. But when the 6months were up they never let me go back to regular payments and made me do a re-modification and this mean't 2 payments up front and 6 mths of paying in theremod plan.But on the day I faxed it in they claimed that it was just a few minutes too late and so they were going to foreclose. I HAD PROOF IT WAS FAXED ON TIME! I didn't know at the time but this is when everybody around the globe was having the same problems. The next thing I know, after not being able to get a lawyer in my area to represent me.

I asked to have my equity and they assured me. I mean, all I was doing was transferring the loan out of my husbands name. I never looked, just thinking I had my equity.. then when I did I realized I owed over 95,000 to the company with no equity. They also informed me that my payment would be going up 200.00 dollars the next year. So I tried to hurry and re-finance, but the loan was so new, no one would touch it. They tried foreclosing on me when I couldn't pay the higher payments.. but I got it reversed and started a loan modification. where I paid 2 payments up front then paid 6 mthly installments and then was supposed to go back on my regular payments.

I had Washington Mutual for 10 years on my home loan. Bought my house for 89,500 (a steal) 2500 sq.ft, 4 br 2 b home. paid it down to 62,000 in 10 years. So i divorced and tried getting the loan in just my name but Washington Mutual no longer serviced my area.. HENCE. I found Ameriquest online. Big mistake! at the time, I wasn't working ( injured on the job Physical Therapist ) tHey were jumping at my feet to get my loan, which at the time, I thought was odd.. since I had no job and such an injury where there was no prospect of me returning to work anytime soon, It was so easy to get this loan.. and after I signed, they immediately told me they had made a mistake on my interest rate and it went up 3 points and I wasn't told until I had already signed the papers.

Yes my wife & I received are check for the total sum of $52.10, we live in Ohio. After talking to a friend that's in the Mortgage business we found out that Argent Mortgage stole over $6,000.00 of our own money when we refinanced are home and cashed out on some equity. Feeling just a bit more then just slighted at this point. However, on a better note don't go cashing those Big checks right away, if you do I found out that you lose any and all rights when the checks are cashed, that meaning that you accept that amount as payment of the settlement.

I think ameriquest is connected to American Express. I am in Detroit and I so needed this money. God is going to get someone about this - it is so unfair. My son-in-law could not believe what he read in our ameriquest mortgage. How can they get away with this. I smell something that really stinks. Does anyone have a conscience anymore? What can we do? The sad part is I was working with one of the Attornies on this case. I had been with them since 2005, I supplied them with all the information about my loans. So please tell me where in the hell are these lead plaintiffs at? I want to see the attornies they were working with and their names. Because I think we got taken by the attornies also. I sure as hell didn't get no 7,500 dollars for providing my information, staying in contact with the attorney. There is something fishy going on here!... So yes we need to do something. Nothing like being ripped off by the attornies and the courts also.

I had two loans. I got a check for the first one. $48.34 cents. I called on the second one and they refused to tell me the amount. Said that since I filed over the internet, the check was sent to the property address ( which I have not owned for over 6 years.) We lost over 80,000 in so called fees we had to pay. Ameriquest refused to cash our house payments. Finally had to hire attorney to save the second house. So... big difference you loose $80,000 and get a check for 48.34... and then those idiots still changed my information i filed with ( the correct address ) and sent the other payment to the old property.. they said oh well. We need to go after them, they are crooks.

They changed my 30 year loan to a 40 year loan and they changed my fixed rate to an ARM without me ever knowing!! I found out when I applied for a loan modification... and all I get is $50!!! I wonder how much the Judge (Marvin E. Aspen) was paidoff for this fraud? How is this Justice? I'm in Cleveland, OH, anyone report to the Ohio news on this?

I received $189.99 last week. The loan was absorbed/bought /serviced by three of the companies listed in the lawsuit. While the amount seems low, and eventually I was approved for a Grade A loan by another lender, am in disbelief over all of this.

Just got my chk dated 10/15/10 and I live in Maryland. It's a whopping $48.34! I guess I should be grateful because I got fired 20 weeks ago and still no unemployment benefits. So much for doing what you're supposed to do as a working class citizen.

We got a check for $48.34. I could not believe it! We were lucky because we did not lose our home but getting the loan was very costly so needless to say we did not make anything when we sold it. I have read everything on the mdl settlement page and according to that we should have gotten around 2900.00 they said it would be based on 60 months. So my thought is $48.34 X 60= $2900.40. but that is just wishfull thinking. they also stated that the settlement was like 695 million so if you divide that by :-[the 170,000 they said had filed claims that would be a lot more than 48.34 How come we keep getting the shaft, was hoping for the money to pay medical deductables since not cost of living increase for us seniors

So, my wife and I just received our $52 check! These folks sold me a fixed 30 year loan, that, in two years, miraculously turned into an ARM... This was our second house, planned on staying at least 10 years, and, now, are months away from foreclosure due to 50% our doing and 50% this damn payment sky rocketing! We were ripped off.

I had to laugh my hubby and me split $24 dollars each today. Let us know the costs. As you know we are broke people here. Also the lawyers and plaintiffs should also be investiigated for tricking us all. Someone needs to copy all the documents in the website before they take them off. And not sure if i am the only one here, but i never got notice on the first lawsuit which seemed to have paid off a little more???

Conference call tomorrow with Mr. Knight P.A. hopefully we will have some recourse in going after what is rightfully ours & will make enough noise that, this will never happen to others again! If all who are interested in pursuing this & willing to put their substantial (LOL) checks to hiring an attorney 'if we have a case' please give me a standing head count!? I want to know if there's a list of people who received settlements from this lawsuit! I DON'T TRUST THIS COMPANY ONE BIT!! Seems to me that the number of people commenting on this site is pretty low... if there were 122,000 involved, wouldn't there be a lot more screaming and yelling going on? How many of us are commenting - like 100 at the most? The judge that reviewed and approved this settlement needs to be slapped! We were RIPPED OFF - laws were BROKEN, people lost their homes, families were destroyed... how is $50 going to in any way near compensate us for the HELL they put us through? My son got a bigger settlement from a former employer who didn't do anything close to what Ameriquest did to us! WHERE IS THE LIST OF WHO RECEIVED PAYOUTS FROM THESE RIPOFF ARTISTS?

I feel like a fricking fool!! First I got duped by Ameriquest - they did so many illegal things with my loan.... forgeries, illegal notarizations, overstating of income, removed my ex-husband from the title, etc., etc., etc.... what made me think that NOW they were going to do anything different... that NOW they were going to be aboveboard and legitimate? This company was run by a bunch of lying thieves... they saw a way to rip us off and get away with it and never looked back!! Now they found a way to legally avoid getting sued by at least 122,000 of the people they defauded... how much did this cost them... 22 million!! Do the math - If they ripped each of us off for $10,000 each (lowball), they got away with $1,220,000,000 (that's one billion, two hundred twenty million dollars). OK, so they had to pay out $22,000,000 - big deal, they still made off with $1,198,000,000! !!

FIrst, I thought there were 700,000 claimants, but then I got my big check for 52.10 and it stated that there were only 170,000 claimants. I could almost bet there is definitely some deceit going on. I've been waiting 8 freaking months for $52.10..Had I known it, I would have not answered them and waited on the next lawsuit..This is definitely a bunch of mess, and where is the interest on the money. As I see it, we only helped the lawyers get fat wallets, because without our support, they wouldn't have gotten a damn dime. What jerks...I'm pissed...I agree with Trish, I will never ever get into another lawsuit..I was counting on that money, I thought justice was finally done to Ameriquest, whereas it wasn't.

If anyone does find out if there is anything that we can do about this (such as hire a personal attorney) please post. We had two loans & received two checks, one for $48 and the other for $52. The math adds up. It was settled at $22million, subtract $200,000 for the foreclosure fund, 33% (or $14,740,000) for attorney, then 170,000 of us @ $50 ($8,5000,000). I feel like a idiot. I will not be a part of a class action suit again.

Well the only one left to help and I believe it was in one of his speeches before he got elected to be the President is President Obama. He should make some provisions to the ones in this suit. I believe I scrolled back and read something about that. Everyone start writing the White House. I believe that there is something we can do. Even though they say you can't. There is the supreme court. If there is not justice for this, then this world is going down hill fast. So sad. On the bright side Maybe President Obama will read this and do something. And yes the news stations are picking this up. Our local station reported on this last night. Remember you can sue just about anyone for anything. But I have been in contact with an attorney, they are looking over everything right now and yes this can be a bait and switch also.

This is what you call the typical Bait and Switch. If you all remember there was another multi-state class lawsuit that was going on! You could claim a onetime payment of 500-700 dollars. Many people chose to stick with this claim because you were told the payment could be around 1,000 or more. In the mean time Mr. Roland Arnall, passed away while traveling! The founder of Ameriquest. Remember Ameriquest no longer exists. He sold the company and re-adjusted things. His wife inherited everything. We were all being set up! Yes even by the lead plaintiffs. And to think I was told I was a lead plaintiff and supplied all my paperwork and information to one of the Attorneys. They need to supply the names of these Lead Plaintiffs. If I recall in one of the court Docs it states they did, but I don’t see them on the website anyplace. I would be that the lead plaintiffs are friends of the attorneys. You can only assume this, because until they are produced, you can’t trust anyone anymore.

Not sure how they calculated giving us the same amount for 2 different mortgage amounts????? We are very pissed too. There should be another check on the way. In my opinion, we all were used for ther class action suit to allow them to take thousands for themselves. Such frauds! Something is definitely wrong with our money received.

The more people that are aware of the situation the better the cause. They had a tax for people to buy houses, they need to have a tax for the people that got taken by these companies. The government is suppose to protect it's citizens, it failed so give all the people a 10,000 bonus on taxes for being a victim of these fraudulent companies. I know it sounds far fetched but my attorney told me this, trying to cheer me up! But he was serious about contacting your local news stations. It sure couldn't hurt.

:-D Hold onto all your paperwork. I had two loans with Ameriquest. They only paid on one of them. I filed two claims and the combined them. My attorney is looking over everything and from what he says they can not combine loans and only pay as one. So everyone do not throw your paperwork away. Save everything, the stuff they sent you in the mail. The form you filed online. From what My attorney said, and what he can see in how they handled my two loans, there is criminal activity going on. You can not combine loans. He is reading all the paperwork that they have put on their site, the court docs and all. So yes there might be happy days coming soon! And to all that had more than one loan, please pay special attention to what they have done on your loans.. Keep your paper work for evidence.

I think they used us to get more support for their pockets. Finally got through after holding FOREVER...Class 4...3,424 points...$52.10 coming in the mail! The year I almost lost my house, I paid $24,000 in interest!!! Then, I still lost it the following year. I'm sure this $52.10 will make me feel much better about the whole thing!

Well look at it this way! they won't be reporting 48.00 to the IRS... So at least you don't have to pay taxes on it. Some people only got a mere$0.04 cents. So be grateful for what you got I suppose. I do know there is talk about getting an attorney and sueing the attornies who got millions on our behalf. Funny it seems like everyone else gets justice except the ones that lost their homes and paid thousands to Americaquest. Any suggestions of what people want to do to rectify this horrible situation? Remember the founders of Ameriquest has passed away, but his wife inhereited all our money.......... that we paid to Ameriquest in a sense. Wonder if you can sue the spouse????

I lie awake at night hoping that this is all a nightmare that I'll wake up from some day but it just gets worse and worse. Why even play with our emotions like this and pretend that they're going to give us some monetary compensation for the pain and suffering they've caused us, when these little checks are just a tiny fraction of what they stole from us? They ripped me off for over $300,000 and now they're going to offer me $60 (if I'm lucky - I don't even want to call because I know I'll probably start crying and I can't afford to do that at work) as compensation? I cannot tell you how disappointed I am. Ameriquest has literally destroyed hundreds of thousands of lives. Yes I understand that a house is only a material possession and at least I have my health (for now), but when you see your mortgage payment go up from $725 a month to over $3,000 a month and barely make enough money to cover the mortgage payment ONLY (I'm a single mom), how can you help but feel bitter and resentful that these people got away with stealing thousands of millions of dollars from us, and then not serve a day of jail time, probably on vacation in Barbados or something sipping tropical drinks on the beach while I'm working at Jack-in-the-Box at night dealing with drunks in the drive-thru and people soiling the restroom since THEY don't have to clean it up, and my office job during the day just to keep a roof over my kids' heads and food in their mouths?!!!

This seems so unfair, when I bought my mobile home, the guy took me to my bank and put money in my account and took it out, then lied to me about the adjustablle rate mortage, and you are saying for all this fake stuff he did to get the loan to go through, my trouble is only worth $40.00. I was just on another website (http://www.webanswers.com/legal/when-are-checks-being-sent-out-for-ameriquest-mdl-settlement-for-2010-af1de2?page=16) where posters were saying they had received checks (mailed out on 10/15/10 - this is possible since it's been 3 days) or had called Rust Consulting and found out the amount of their settlements this morning. The amounts ranged from $30 to $60. You guys need to take down the misleading information at the top of this page that says each claimant is likely to receive at least $1,000.00. Really disappointed!!

We had our home years and years before this bullshit liars loan and we lost everything we had. Okay, I have been to so many different sites just reading. The facts are never an issue only speculation. We hope for justice and pray we get it. The fact is, there were 700,000 (POSSIBLE) claimants. In reality, there were less. On Cnn, just before the trial began, they reported 122,000 were included in the suite for this claim. Now if this is in fact true, exactly how many of those were valid claims? From past expirience I had a claim on a class action with Check and go. I expected a check for $20.00. Imagine my surprise when a check for $3200.00 arrived. I once had a class action with H & R Block and got a whole $1.50. If in deed we get mere crumbs and others still gained while we all lost our homes I will not be silent in no way! I will yell bull shit loud and clear and have counsel waiting to see what these nice people do for us! In reality a rip off scam weather it be bait and switch or ate up with legal fees is correctable with dilligence.

My question is, just because you received the notice that you were a part of this class action lwawsuit, does that make you qualify for at least one category. They are crazy, probrably holding things up to? I agree, if they stated all should get atleast $1000, then I believe its the truth, people on the other site are talking about 18 cent and 20 dollar payouts, that would cause a riot, LOL. Jewel, I think you are right. I think the smallest amount you would get would be slightly over $1000.00 if involved in only one class but if you would be involved in multiple classes then the payment would go up for each class you were involved in. I think they should have put something out to let us know what class or classes we were involved in.

I think the 87 named plaintiffs are not us in the general class members list?? I believe they were the l;eads plaintiffs who brought about this suit? Its a little confusing. But i did read there was 700,000. They will pay the lawyers over 7 million so there wont be so much left. I dont quite understand the formula either on the information site. And lastly they should not hold no one monies if they are due. Can someone figure this out??

This is copied from the final judgement and settlement..... 12. The Court has considered submissions concerning Service Payments for each of the Named Plaintiffs in the amount of $7,500 (plus interest accrued thereon from the date interest begins to accrue for the benefit of the Settlement Fund). The Court approves such awards to 87 Named Plaintiffs, based on a finding that such amounts represent an appropriate payment for service to the Settlement Classes.

The other thing that I read in the lawsuit said that there are 87 class plaintiffs who should receive 7500.00 judgements. It is a wonder that they do not publish a list of plantiffs. I submitted my claim on line and was hoping to get something in the mail at least notifying us that we are still part of the laswsuit. Not hearing anything makes you second guess yourself that you actually submitted on time or did it right.

Has anyone heard from anyone? No emails, letters, phone calls to even tell me what the hell is going on! Its like I dont exist. I submitted the claim form online way before the date needed and have not heard crap. SO ANGRY! For all the AHMSI customers...I think they ripped me off as well and there has to be a law that states they cannot charge a $16.95 fee for checks over the phone...Western Union doesnt charge that much-why are they? as of today, its still a waiting game...you can go to ameriquestmdlse ttlement.com for info, but the same message is there about pending appeals, etc....if you call the info number, you basically get the same thing, the earliest payment will be made is summer of 2010, which means good luck getting anything before the end of the year, if ever...what a joke...Amerique st can rip people off and take their money instantly but we have to wait forever for a small fraction of what they took.
