Details: The Canadian Export Antitrust litigation began in 2003 when several lawsuits were filed in state and federal courts across the country claiming that several of the largest automakers (including Chrysler, Ford, General Motors, Honda, Nissan and Toyota) and certain trade associations (including CADA) conspired with each other to prevent virtually identical, but cheaper, new cars from being exported to the United States from Canada. All of the federal cases were consolidated into one case called In re New Motor Vehicles Canadian Export Antitrust Litigation.

The Canadian Export Antitrust class action lawsuit alleged that by conspiring to prevent this cheaper supply of cars from entering the U.S. market, U.S. automakers were able to keep the prices of new cars in the United States higher than they should have been. As a result, thousands of U.S. citizens purchased cars at inflated prices between 2001 and 2006. In 2006, Toyota and CADA agreed to settle the class action lawsuits in order to avoid the risks and costs of litigating the case.

Under the Toyota and CADA class action settlement, Toyota has agreed to pay $35 million and CADA has agreed to pay $700,000 for the benefit of the class. Only certain class members, however, will receive money from the Toyota and CADA settlement.

So how do you know if you’ll receive money from  the Toyota and CADA class action lawsuit settlement? That depends on what type of vehicle you purchased, when and where you purchased it, and where you were living when it was purchased. You’re eligible to receive money from the class action settlement only if all of the following apply to you:

(1) You purchased or leased a new motor vehicle (passenger car, light truck or SUV) during the period of January 1, 2001 to April 30, 2003;

(2) You currently reside or have a principle place of business in the United States;

(3)At the time you purchased or leased the new motor vehicle, you resided or had your principal place of business in the following “Eligible States”: Arizona, Arkansas, California, Idaho, Kansas, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Nebraska, Nevada, New Hampshire, New Mexico, North Dakota, South Dakota, Tennessee, Vermont, West Virginia, or Wisconsin;

(4) You purchased or leased the vehicle from an auto dealer located in an Eligible State; and

(5) The vehicle your purchased was one of the following makes:

Acura

Audi

BMW

Buick

Cadillac

Chevrolet

Chrysler

Dodge

Ford

GMC

Honda

Hummer

Infiniti

Jaguar

Jeep

Land Rover

Lexus

Lincoln

Mazda

Mercedes

Mercury

Mini

Nissan

Oldsmobile

Plymouth

The amount of money you’ll receive from the total $35.7 million combined Toyota and CADA class action settlement will depend on the make and model of the car you purchased, when you purchased it, and how many claimants there are. For more information on how to calculate your estimated settlement payment, see the Toyota & CADA Class Action Settlement Notice.

All claim forms must be submitted no later than February 1, 2011. Go to www.canadianexportantitrust.com now to submit your claim form online and get your share of the Toyota & CADA class action lawsuit settlement!

    Well despite having an email address verifying my claim and having a claim ID number, they told me that they could not find my claim in their database. I have talked with several people about this and they have checked my claim several times but now they are telling me that my claim number belongs to someone else………. This is crazy, I just stop calling because they were pissing me off.
