Jason Ester-CA federal class action lawsuit claims The Hain Celestial Group misleads consumers into purchasing its Jason and Avalon Organics branded cosmetics by claiming they are “pure” and “organic,” even though they contain “significant amounts of non-organic ingredients.”

According to the Hain Celestial class action lawsuit, titled Rosminah Brown v. The Hain Celestial Group, Inc., Hain markets and labels its Jason and Avalon Organics brands as “organic” even though they contian less than 70% organic ingredients. The California Organic Products Act of 2003 (COPA) requires any cosmetic product sold, labeled or represented as “organic” must be comprised of at least 70% organic ingredients by weight. California law also expressly prohibits companies from engaging in misleading labeling.

“In recognition of the fact that consumers will pay more for organic products, Defendants prominently place the word ‘organic’ at the top of the front of every label of the Products. Jason Products are all labeled as ‘Pure, Natural & Organic,’ while Avalon Organics branded Products all have ‘Organics’ in the actual name of the Product. Nevertheless, the Products are largely comprised of ingredients which Defendants admit are not organic,” states the class action lawsuit.

For example, the Jason Ester-C Super-C Cleanser Facial Wash states on the front label that the product is “Pure, Natural & Organic.” However, out of the 19 ingredients listed in small print on the back of the bottle, only one is certified organic. The sole ingredient, Aloe Barbadensis (Aloe Vera) Leaf Gel, is not even the most prominent of the 19 ingredients and ranks ninth on the ingredient list in terms of its predominance in the product.

The Hain Celestial organic class action lawsuit is brought on behalf of all persons who purchased the Avalon Organics and Jason branded cosmetics in California during the applicable statute of limitations. It is seeking a corrective advertising campaign, full refunds to all consumers who purchased the products, and other injunctive relief.
