Details: The Capital One Payment Protection class action lawsuit alleges that the process for obtaining benefits under the Payment Protection plan was too difficult. It also alleged that Capital One did not adequately disclose the restrictions on the benefits that are based on the customer’s employment status at the time of enrollment before they enrolled in Payment Protection.

Under the Capital One Payment Protection class action lawsuit settlement, you may be able to file a claim for a credit or cash refund if you meet the following criteria:

(1) You are a current or former Capital One credit card holder who first enrolled in Payment Protection at any time between September 28, 2003 and July 31, 2010 while residing in Florida.

(2) You are a current or former Capital One credit card holder who first enrolled in Payment Protection at any time between January 1, 2005 and July 31, 2010 while residing in any other part of the United States.
Â
To receive a benefit under the Capital One Payment Protection settlement, you must submit a valid claim form, signed under penalty of perjury, postmarked by December 31, 2010. Class members who currently have a Capital One credit card or if their account charged off with money owing on their account will receive payment in the form of a credit. Those who closed their Capital One credit card with no money owed to Capital One will receive their benefit by check. You can download a claim form at www.spinellisettlement.com.

The amount of your Payment Protection settlement benefit will vary, depending on whether your account is open, closed, in good standing or charged off. It will also depend on whether or not you ever attempted to activate Payment Protection benefits and whether or not you received these benefits.

If you attempted to activate and received Payment Protection benefits, you could receive between $15 and $20. If you never attempted to activate Payment Protection benefits, you could receive between $15 and $28. If you attempted to activate, but did not receive Payment Protection benefits, you could receive between $15 and $63.

I was only made aware of a lawsuit this year via news and internet. It was stated that Capital One would start making payment this year. Also stated that you didn’t have to file a claim. Everyone involved would be compensated. Maybe this is not the same claim.
can someone tell me what happen with the settled I am part of the Lawsuit. Help?
i was part of this and mailed all the forms back to four different parties.. was not informed that i had the coverage and ended up on disability.. they took a balance of under two hundred dollars and added charges and penalties and it ended up being over two thousand.. i wanted all the charges wiped out and removed from my credit record.. have not heard a peep from anybody involved..all adds up to crooked banks and courts…i guess…

I received a notice of the class action lawsuit and proposed settlement and missed the deadline of 12/31/10. I am not seeking any reimbursement of funds, but would like the negative action removed from my credit report because Capital One would not allow me to utilize the payment protection that I was paying for when my husband lost his job and our income was reduced. Please tell me what I can do under this settlement.
