Amusement Park Class Action Settlement
By Sarah Pierce
Â
The amusement park class action settlement will resolve a federal lawsuit filed in August against Palace Entertainment Holdings, LLC; Festival Fun Parks, LLC; and Palace Entertainment Management, LLC by a man who said his credit card receipt at Idlewild & Soak Zone park in Ligonier, Pennsylvania, contained his credit card’s expiration date. This violates the federal Fair and Accurate Credit Transactions Act (FACTA), which prohibits merchants from printing more than the last five digits of a credit card number or the expiration date on receipts in order to protect credit card customers from identity theft.
Class Members of the Palace Entertainment class action settlement include all persons who received an electronically printed receipt from one of the following amusement parks between December 4, 2006 and December 20, 2011 that displayed more than the last five digits of their credit or debit card number, and/or the expiration date of their card number:
Castle Park (Riverside, CA)
Emerald Pointe Wet n’ Wild (Greensboro, NC)
Idlewild & SoakZone (Ligonier, PA)
Kennywood (West Mifflin, PA)
Lake Compounce (Bristol, CT)
Mountain Creek (Vernon, NJ)
Raging Waters (San Dimas, CA)
Sandcastle (Pittsburgh, PA)
Sea Life Park (Waimanalo, HI)
Silver Springs (Silver Springs, FL)
Splish Splash (Calverton, NY)
Water Country (Portsmouth, NH)
Waterworld (Concord, CA)
Wild Waters (Silver Springs, FL)
Under the Palace Entertainment amusement park class action settlement, Class Members who submit a valid claim form will be entitled to receive one free admission ticket to a participating Palace amusement park for any date that the park is open for business between June 1, 2012 and June 28, 2012 and September 4, 2012 and September 30, 2012, which has an estimated retail value of $27.58.
Claim forms must be submitted online at http://www.civ211-cv-00987-gllclass-tixnotice.info by February 13, 2012.
The case is Hanlon v. Palace Entertainment Holdings, LLC, et al., Case No. 11-cv-00987, U.S. District Court, Western District of Pennsylvania.
